A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,DECLARING THAT A CERTAIN FEDERALLY PATENTED
EASEMENT FOR PUBLIC RIGHT-OF-WAY PURPOSES ON NORTH WINCHESTER
ROAD IS NO LONGER NECESSARY FOR PUBLIC USE AS A ROADWAY AND IS
HEREBY ABANDONED AND EXTINGUISHED AS A PRESENT OR FUTURE PUBLIC
RIGHT-OF-WAY.
WHEREAS,James and-Reda Bunnell have made application for the
abandonment of a federally patented easement on their property de-
scribed i n this resolution;and
WHEREAS,the requested abandonment i s an easement for public right-
of-way purposes described as follows:
Parcel No.1
The West 33 feet of the West 1 of the Northwest /of the Northeast
/of the Northwest A of Section 21,Township 1 North,Range 8 East,
Gila and Salt River Base and Meridian,EXCEPT the North 396 feet
thereof,located in Apache Junction,Pinal County,Arizona.
Parcel No.2
The West 33 feet south of the Arizona State Route 88 southerly
right-of-way line of the North 396 feet of the West 1 of the
Northwest A of the Northeast of the Northwest of Section 21,
Township 1 North,Range 8 East,Gila and Salt River Base and
Meridian,EXCEPT the North fifty (50)feet thereof,located in
Apache Junction,Pinal County,Arizona;and
WHEREAS,the said federally patented easement for public right-
of-way purposes as described herein is only a one-half width street
entirely on the applicants'property;and
WHEREAS,the City Council of the City of Apache Junction,Arizona,
finds that the said federally patented easement for public right-of-
way purposes as described herein is no longer necessary for public use
as a roadway;
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of
the City of Apache Junction,Arizona,that the above -described federally
patented easement reserved for public right-of-way purposes is hereby
abandoned and extinguished as a present and future right-of-way.
BE IT FURTHER RESOLVED that the abandonment of the public right-
of-way has no effect on reservations for public utility easements.
