A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,DECLARING THAT A CERTAIN
FEDERALLY PATENTED EASEMENT FOR PUBLIC RIGHT-OF-WAY
PURPOSES ON EAST SIXTH AVENUE AND SOUTH PADRE ROAD
IS NO LONGER NECESSARY FOR PUBLIC USE AS
A ROADWAY AND IS HEREBY ABANDONED AND EXTINGUISHED
AS A PRESENT OR FUTURE PUBLIC RIGHT-OF-WAY.
WHEREAS,C.D.Wyatt,Jr.,Michael Kovacs,and First
National Land Company have made application for the abandonment
of a federally patented easement on the property described
in this resolution;and
WHEREAS,the requested abandonment is an easement for
public right-of-way purposes described as follows:
Parcel No.1:
The north 33 feet of the West of the Southeast A of the
Southeast A of the Southwest A of Section 21,Township 1
North,Range 8 East,Gila and Salt River Base and Meridian,
lying north of the north right-of-way line of U.S.Highway
60,located i n Apache Junction,Pinal County,Arizona;
EXCEPT the west 33 feet.
Parcel No.2:
The east 33 feet of the West 1 of the Southeast A of the
Southeast A of the Southwest A of Section 21,Township 1
North,Range 8 East,Gila and Salt River Base and Meridian,
lying north of the north right-of-way line of U.S.Highway
60,located i n Apache Junction,Pinal County,Arizona.
Parcel No.3:
The north 33 feet of the East 1 of the Southeast A of the
Southeast A of the Southwest A of Section 21,Township 1
North,Range 8 East,Gila and Salt River Base and Meridian,
located i n Apache Junction,Pinal County,Arizona;EXCEPT
the east 40 feet.
Parcel No.4:
The west 33 feet of the East A of the Southeast A of the
Southeast A of the Southwest A of Section 21,Township 1
North,Range 8 East,Gila and Salt River Base and Meridian,
lying north of the north right-of-way line of U.S.Highway
60,located i n Apache Junction,Pinal County,Arizona.
Parcel No.5:
The south 33 feet of the South 1 of the Northeast A of the
Southeast i of the Southwest of Section 21,Township 1
North,Range 8 East,Gila and Salt River Base and Meridian,
located in Apache Junction,Pinal County,Arizona;EXCEPT
the east 40 feet; and EXCEPT the west 33 feet.
WHEREAS,the abandonment requested,i f approved,would
not leave a parcel in separate ownership without access
to an established public roadway connecting such lands with
another public roadway;and
WHEREAS,the City Council of the City of Apache Junction,

Arizona,finds that the said federally patented easements
for public right-of-way purposes as described herein are
classified as a local street on the Apache Junction Street
Classification Plan,and are no longer necessary for public
use as a roadway,
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City
Council of the City of Apache Junction,Arizona,that the
above -described federally patented easement reserved for
public right-of-way purposes is hereby abandoned and
extinguished as a present and future right-of-way.
BE IT FURTHER RESOLVED that the abandonment of the
public right-of-way has no effect on reservations for public
utility easements.
PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF APACHE JUNCTION,ARIZONA,THIS 7TH DAY OF
September,1982.
