HomeMy WebLinkAboutRES 82-32RESOLUTION NO.82-32 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,DECLARING THAT A CERTAIN FEDERALLY PATENTED EASEMENT FOR PUBLIC RIGHT-OF-WAY PURPOSES ON WEST GREASEWOOD STREET AND NORTH CEDAR DRIVE IS NO LONGER NECESSARY FOR PUBLIC USE AS A ROADWAY AND IS HEREBY ABANDONED AND EXTINGUISHED AS A PRESENT OR FUTURE PUBLIC RIGHT-OF-WAY. WHEREAS,Roger and Joyce Gupton and John Hirambasic have made application for the abandonment of a federally patented easement on the property described in this resolution;and WHEREAS,the requested abandonment is an easement for public right- of-way purposes described as follows: Parcel No.1: The west 33 feet of Lot 36 of Section 18,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,located in Apache Junction,Pinal County,Arizona;EXCEPT the south 50 feet thereof. Parcel No.2: A portion of the west 33 feet of Lot 33 of Section 18,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian, Pinal County,Arizona,being more particularly described as follows: Beginning at the southwest corner of said Lot 33; Thence North 00°01'08"East,280.05 feet along the west line of said Lot 33; Thence along a curve to the left 36.05 feet,said curve having a radius of 50.00 feet,central angle of 41°18'28"and long chord bearing North 69°21'42"East,35.27 feet; Thence South 00°01'08"West,292.48 feet; Thence South 89 059 140"West,33.00 feet along the south line of said Lot 33 to the true point of beginning. Parcel No.3: A portion of the north 33 feet of Lot 33 of Section 18,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian, Pinal County,Arizona,being more particularly described as follows: Commencing at the northeast corner of said Lot 33; Thence South 89°59'21"West,33.00 feet along the north line of said Lot 33 to the true point of beginning; Thence South 00 000 146"West,33.00 feet; Thence South 89°59'21"West,589.74 feet; Thence along a curve to the left 36.04 feet,said curve having a radius of 50.00 feet,central angle of 41°18'13"and long chord bearing North 20°38'32"East,35.27 feet; Thence North 89°59'21"East,577.31 feet along the north line of said Lot 33 to the true point of beginning. Parcel No.6: The east 33 feet of Lot 35 of Section 18,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,located i n Apache Junction,Pinal County,Arizona;EXCEPT the south 50 feet thereof. WHEREAS,the abandonment requested,i f approved,would not leave a parcel in separate ownership without access to an established public roadway connecting such lands with another public roadway;and WHEREAS,the City Council of the City of Apache Junction,Arizona, RESOLUTION 82-32 PAGE THREE finds that the said federally patented easements for public right-of- way purposes as described herein are classified as local streets on the Apache Junction Street Classification Plan,and are no longer necessary for public use as a roadway, NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that the above -described federally patented easement reserved for public right-of-way purposes is hereby abandoned and extinguished as a present and future right-of-way. BE IT FURTHER RESOLVED that the abandonment of the public right- of-way has no effect on reservations for public utility easements.
