AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,APPROVING THE SITE PLAN AND ARCHITECTURAL
ELEVATIONS OF A GASOLINE DISPENSING/CONVENIENCE MARKET THROUGH A
PLANNED DEVELOPMENT MAJOR AMENDMENT IN CASE P7-97-27 FOR A 1.38
ACRE (NET)PROPERTY,ZONED C-3/PD (GENERAL COMMERCIAL DISTRICT/
PLANNED DEVELOPMENT),AT THE NORTHEAST CORNER OF WEST SOUTHERN
AVENUE AND SOUTH IRONWOOD DRIVE;REPEALING ANY CONFLICTING
PROVISIONS:AND PROVIDING FOR SEVERABILITY.
WHEREAS,the Mayor and City Council of the City of Apache Junction,Arizona,
on October 18,1988 passed and adopted Ordinance No.649,amending the Apache
Junction,Arizona,Zoning Ordinance,by amending the Zoning District Map.City
of Apache Junction.Arizona,changing the zoning district classification in
rezoning case P7-88-03,on 149.35 acres more or less;from GR (General Rural)
to C-3/PD (General Commercial/Planned Development),that includes. the 1.38
acre (net)property:C-2/PD (Local .Commercial/Planned Development):CR-2/PD
(Single -Family Residential/Planned Development):CR-3/PD (Single -Family
Residential/Planned Development):and CR-5/PD (Multiple -Family Residential/
Planned Development);and
WHEREAS,said Ordinance No.649 is now in full force and effect;and
WHEREAS,said Ordinance No.649 is a valid ordinance of the City of Apache
Junction,Arizona and i t is the specific intent that Ordinance No.1017 shall
not affect the validity of Ordinance No.649 as passed and adopted on October
18,1988:
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
THAT:
SECTION I IN GENERAL
The site plan and architectural elevations of a gasoline dispensing/
convenience market be approved,retaining the C-3/PD (General Commercial/
Planned Development)designation.for the parcel of land legally described as
follows:
Being a portion of the Southwest quarter of Section 29.Township 1
North.Range 8 East of the Gila and Salt River Base and Meridian,Pinal
County.Arizona described as follows:

Commencing at the Southwest corner of said Section 29:
Thence North 300.00 feet along the West line of said Section 29:
Thence East 50.00 feet to the easterly right-of-way line of Ironwood
Drive and to the point of beginning:
Thence North 89°49'48"East 240.00 feet:
Thence South 0°00 00"West 250.72 feet to the northerly right-of-way
line of Southern Avenue:
Thence South 89°59'43"West 220.00 feet along said northerly right-of-
way line to a tangent curve:
Thence Northwesterly along said curve,concave northeasterly having a
radius of 20.00 feet through a central angle of 90°00'17 ,an
arc distance of 31.42 feet to said easterly right-of-way line:
Thence North 0°00'00"East 230.00 feet along said easterly right-of-
way line to the point of beginning.
The above described parcel contains 60,000 square feet or 1.38 acres.
Subject to the following stipulations:
1)Appropriate development fees,as well as all other applicable fees.
are due at such time as a building permit is issued for the gasoline
dispensing/convenience market.
2)The developer may construct temporary driveway accesses into the site
from Ironwood Drive and Southern Avenue.as approved by the City
Engineer.The City will make the perimeter street improvements along the
subject property on Ironwood Drive and Southern Avenue when the
remainder of the 20.22 (NET)acre commercial corner is developed.
3)The developer makes the necessary changes to the proposed development
in accordance with the comments received by the City Engineer,Fire
District,Police Department,Arizona Water,Public Works and Planning
Division.
4)No outside display of merchandise is permitted
5)The required 6 -foot high masonry wall along all interior property
lines (6-1-5.D.2.Landscaping and Screening Requirements)is waived.
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.

SECTION III PROVIDING FOR SEVERABILITY
If any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference is for any
reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction,such decision shall not affect the validity of the
remaining portions thereof.
