PAR9a 2:West half of the East half of the Northwest qy rter of the Northwest quarter of the Northeast quarter of ,Section 15.Township 1 North,Range 8 East,Gila and Salt River / Base and Meridian,Pinal County,Arizona. be and /Kereby is amended from R1-43 (Single Family Residential,1.25 acre minimten parcel size in areas with federally patented easements,1.0 acre mini/mum without federally patented easements,conventional construction only) to/FR (Transitional Zone,10,000 square feet for residential uses);subject to the following stipulations: ORDINANCE NO.1020 PAGE ONE OF FOUR 1.The subject property will be developed in accordance with the site plan submitted. 2.Development of the subject property will comply with the Uniform Building Code and all other applicable standards as adopted by the City of Apache Junction. 3.All requirements of the City Engineer will be satisfied during the building permit application and review process. 4.A maximum of 15 horses shall be permitted on the property, delineated as follows:no more than 4 to be belonging to the owner of the property,with a further 11 being brought by guests.At no time shall there be more than 30 horses on the property for a single event. 5.All licenses and permits required by the City,Pinal County and the State of Arizona shall be obtained prior to issuance of a Certificate of Occupancy for the "Desert Rose Casitas". 6.Manure removal and sanitation of the corral and stable areas shall be in accordance will all applicable City,County and State requirements. 7.If a perimeter fence is desired by the applicant it shall be constructed in the following manner: A 3 to 4 foot wall,using a combination of vege- tation and wrought iron and masonry,and placed in such a manner as to provide delineation of the property,and provide a degree of privacy for the guests;and such design to be approved by the Direc- tor of Development Services. 8.At no time shall the number of people on site exceed the maximum occupancy as determined by the Apache Junction Fire District at the time of building permit application and review. ORDINANCE NO.1020 PAGE TWO OF FOUR 9.All provisions of Article 18.Guest Ranch Regulations shall be adhered to at all times. 10.Allowable signage:one (1)freestanding illuminated or non- illuminated sign,a maximum of thirty-two (32)square feet in area,and a maximum of eight (8)feet in height. 11.Ordinance 940 requirements for landscaping shall be met at a minimum.It is strongly encouraged to preserve the native, natural Sonoran desert. 12.Only areas of sufficient size to accommodate construction of the proposed structures shall be cleared of all vegetation. 13.All parking areas and driving isles will have a decomposed granite surface. SECTION II REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase,clause or portion of this ordinance or any part of the Code adopted herein by reference is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
