HomeMy WebLinkAboutORD1021ORDINANCE NO.1021 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION.ARIZONA.ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP.CITY OF APACHE JUNCTION.ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE NO.PZ-97-31 FROM CR-5 (MULTIPLE FAMILY RESIDENTIAL)TO C-3/PD (GENERAL COMMERCIAL BY PLANNED DEVELOPMENT)FOR THE PURPOSE OF DEVELOPING A FRY'S FOOD STORE AND ASSOCIATED SHOPPING CENTER; REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map.City of Apache Junction.Arizona,for the parcel of land described as: A portion of the Southeast quarter of Section 20, Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona. be and hereby is amended from CR-5 (Multiple Family Residential)to C-3/PD (General Commercial by Planned Development);subject to the following stipulations: 1.The subject property shall be developed within 24 months of rezoning approval or the zoning may revert to its former classification in accordance with Section 19.0111.4 of the Zoning Ordinance. 2.Development of the property shall be in substantial conformance to the approved site plan. ORDINANCE NO.1021 PAGE ONE OF THREE 3.Development of this project will comply with the Uniform Building Code and all other applicable standards as adopted by the City of Apache Junction. 4.All requirements of the City of Apache Junction and other applicable agencies shall be met. 5.An additional twenty (20)feet of right-of-way for Phelps Drive is required. 6.The parcel identified as the eastern 330+/-feet of Pinal County Assessor's Parcel Number 101-14-003 shall: a.Undergo the appropriate land split process to create a separate parcel from the parent parcel of 101-14-003, and b.Shall be combined with the subject property prior to application for a building permit for the Fry's store. c.Prior to July 6,1998 an application for the rezoning of the above reference parcel shall be submitted to the Development Services Department,in accordance with all application schedules and requirements. 7.All requirements of Article 21.Signage of the Zoning Ordinance shall be followed. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. ORDINANCE NO.1021 PAGE TWO OF THREE SECTION III PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase,clause or portion of this ordinance or any part of the Code adopted herein by reference is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
