THENCE North 89°59'24"West along the Southerly line of said Section 33,a distance of 1221.28 feet to the TRUE POINT OF BEGINNING; be and hereby is amended from CI -2 (Heavy Industrial Zone)to CI-2/PD (Heavy Industrial by Planned Development)in order to allow the development of an industrial subdivision to be named Baseline Industrial Park,subject to the following stipulations: 1)The Baseline Industrial Park shall be developed in substantial compliance with the Zoning Concept Plan submitted. 2)The Baseline Industrial Park shall be allowed on -site signage as permitted for uses in industrial districts.No off -site signage is allowed. 3)Businesses locating in the industrial park shall be required to hook up to the Sewer District system. 4)All businesses locating in the industrial park shall be operated in compliance with all Arizona Department of Environmental Quality,Pinal County Health Department and any other applicable health and safety regulations or requirements. 5)Individual businesses locating in the industrial park shall develop and submit landscape and screening plans in accordance with the provisions of Ordinance No.940,subject to approval by the Parks and Recreation Department and the Planning Division,during the building permit process. 6)Proposed high impact uses,as described in the PZ-28-97 rezoning report and/or as determined by the Zoning Administrator or the Development Services Director,shall be subject to approval or denial through a Proposed Use and Site Plan Review Process.Said process shall be for the purpose of: ORDINANCE NO.1022 PAGE 2 OF 4 a)helping to assist in attracting clean industry businesses to the subdivision; b)notifying surrounding property owners within 300 feet of the subdivision that an intense use was being proposed in the area and giving them a chance to be heard;and c)the process would allow the Planning and Zoning Commission to review and make recommendations on high impact use proposals at a public hearing,and would give the City Council the authority to approve or deny the more intense uses based on Commission recommendation, community need, use compatibility and neighborhood input,also within the context of a public hearing. 7)The property owners shall dedicate and improve to the City Engineer's standards any necessary rights -of -way,as determined by the City Engineer, including but not necessarily limited to,the south 50 feet for E.Baseline Avenue and all interior and other perimeter streets of the subdivision, along with any necessary cut-off corners for sight visibility and large vehicle maneuverability.Said improvements may include the provision of curbs,gutters,sidewalks,driveways,streetlights,pavement widening, retention basins,drainage culverts,etc. 8)The property shall be developed within 24 months of rezoning approval or else the zoning may revert to its former classification per Section 19.0111.4 of the Planned Development ordinance. 9)The provisions of the Uniform Building Code and all other City Codes, policies,guides and standards shall apply and control all design and construction of improvements. 10)All construction shall be done in compliance with all applicable codes and ordinances,including the City of Apache Junction Zoning Ordinance,the Uniform Building Code and the Uniform Fire Code (including,but not limited to,the provision of fire apparatus access roads,the marking of fire lanes and the provision of adequate water supplies,sprinkler systems and fire hydrants). SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance,or any part of the code adopted herein by reference,are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
