HomeMy WebLinkAboutORD1025ORDINANCE NO.1025 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION.ARIZONA ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP.CITY OF APACHE JUNCTION.ARIZONA, CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-29-97 FROM CR-1 (CONVENTIONAL SINGLE- FAMILY HOMES ON 20,000 -GROSS -SQUARE -FOOT MINIMUM LOTS) TO C-3/PD (GENERAL COMMERCIAL BY PLANNED DEVELOPMENT); REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map.City of Apache Junction.Arizona,for the parcel of land described as: The Northwest quarter of the Northwest quarter of the Northwest quarter of Section 28;and the North half of the Southwest quarter of the Northwest quarter of the Northwest quarter of Section 28, Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona; be and hereby is amended from CR-1 (Conventional Single -Family Homes on 20,000 -Gross -Square -Foot Minimum Lots)to C-3/PD (General Commercial by Planned Development)in order to allow the development of a commercial/retail center,a mini -storage business and two commercial pads,subject to the following stipulations: 1)The commercial/retail center and future mini -storage shall be developed in accordance with the basic configuration and elevations shown on the submitted preliminary Planned Development plan. 2)The location and construction of driveways and easements for both the commercial/retail center and the mini -storage facility shall be constructed according to City Engineer,Fire District and ADOT specifications;and according to the provisions of Section 20.0108 Private Access Way Standards. ORDINANCE NO.1025 PAGE 1 OF 4 3)As part of the final improvement plans,the applicants shall provide a drainage report and drainage plan for the site,taking into account both existing and additional drainage control and retention structures needed,subject to the City Engineer's review and approval. 4)As part of the final improvement plans,the applicants shall provide a landscape plan in accordance with the provisions of Ordinance No.940, to include,but not necessarily be limited to,screen walls,retention areas and landscape berms for functional,security and aesthetic purposes.Said landscape plans are subject to approval by the Parks and Recreation Department,Planning Division and Police Department. 5)The site and elevation plans for the proposed future mini -storage and restaurant businesses on the Planned Development subject property, either together or separately,shall be subject to a Planning and Zoning Commission recommendation and City Council decision. 6)One -additional sign on each street frontage,for the mini -storage business,shall be allowed,along with and at such time as the site and elevation plans for the mini -storage are approved. 7)The property owners shall dedicate and improve to the City Engineer's standards any necessary rights -of -way,as determined by the City Engineer,including but not necessarily limited to,the south 50 feet for E.Broadway Avenue and any necessary cut-off corners.Said improvements may include the provision of curbs,gutters,sidewalks, driveways,streetlights,pavement widening,retention basins,drainage culverts,etc. 8)The property shall be developed within 24 months of rezoning approval. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved,the legislative body may,after notification by certified mail to the owner and applicant who requested the rezoning,schedule a public hearing to take administrative action to extend or determine compliance with the schedule for development or may take legislative action to cause the property to revert to its former zoning classification. ORDINANCE NO.1025 PAGE 2 OF 4 9)Any use or development of said property may be conditioned upon the provision of public improvements,a decorative masonry perimeter wall, and landscaping in accordance with the provisions of Article 19 of the Zoning Ordinance.The provisions of the Uniform Building Code and all other City Codes,policies,guides and standards shall apply and control all design and construction of improvements. 10)All construction shall be done in compliance with all applicable codes and ordinances,including the City of Apache Junction Zoning Ordinance, the Uniform Building Code and the Uniform Fire Code (including,but not limited to,the provision of fire apparatus access roads,the marking of fire lanes and the provision of adequate water supplies,sprinkler systems and fire hydrants). SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance,or any part of the code adopted herein by reference,are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
