HomeMy WebLinkAboutORD1026ORDINANCE NO.1026 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,APPROVING A PLANNED DEVELOPMENT MAJOR AMENDMENT,CASE PZ-32-97,FOR A 2.5 -ACRE,TRAILER HOMESITES BY PLANNED DEVELOPMENT (TH/PD)-ZONED PROPERTY,LOCATED AT 1851 N. IRONWOOD DRIVE,BY AMENDING ORDINANCE NO.120;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL That Ordinance No.120 be amended with the addition of the following stipulations,pertaining to the development of the following described property,also known as,the north 2.5 acres of the original Planned Development: The North half of the South half of the Northwest quarter of the Southwest quarter of the Northwest quarter of Section 17,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona;EXCEPT for the West 33 feet thereof. The additional stipulations for the property described above and in case file PZ-32-97,are as follows: 1)The future land split shall be executed in accordance with the basic configuration shown on the submitted preliminary plan. 2)The full length and width of the Private Access Easement shall be constructed with either a chip seal surface,paving,ray binder or gravel,being crushed granite leveled and water -packed,to provide a dust -free and relatively erosion -free surface for driving on,per the requirements of the City Engineer. ORDINANCE NO.1026 PAGE 1 OF 3 3)The property owners shall dedicate and improve to the City Engineer's standards any necessary rights -of -way,including but not necessarily limited to,the west 50 feet for N.Ironwood Drive and any necessary cut-off corners.Said improvements may include the provision of curbs, gutters,sidewalks,driveways,streetlights,pavement widening, retention basins,etc. 4)The property shall be developed within 24 months of rezoning approval. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved,the legislative body may,after notification by certified mail to the owner and applicant who requested the rezoning,schedule a public hearing to take administrative action to extend or determine compliance with the schedule for development or may take legislative action to cause the property to revert to its former zoning classification. 5)Any use or development of said property may be conditioned upon the provision of public improvements,a decorative masonry perimeter wall, and landscaping in accordance with the provisions of Article 19 of the Zoning Ordinance.The provisions of the Uniform Building Code and all other City Codes,policies,guides and standards shall apply and control all design and construction of improvements. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
