HomeMy WebLinkAboutORD1033ORDINANCE NO.1033 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,ALLOWING A MAJOR AMENDMENT TO AN EXISTING PLANNED DEVELOPMENT DESIGNATION,CASE NO.PZ-97-26,FOR THE PURPOSE OF DEVELOPING A MINI -STORAGE FACILITY WITH RETAIL SPACE ON THE PROPERTY LOCATED AT THE NORTHEAST CORNER OF SOUTH HILTON ROAD AND OLD WEST HIGHWAY;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map.City of Apache Junction.Arizona,for the parcel of land described as: The West half of the Southeast quarter of the Southeast quarter of the Southeast quarter of Section 27,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona. is General Commercial by Planned Development (C-3/PD);and The existing zoning designation was assigned to the parcel upon annexation into the City of Apache Junction,as outlined in Ordinance 953;and The planned development designation is amended,as requested in Case No. PZ-97-26,to allow the development of a mini -storage facility with retail space, subject to the following conditions: 1.Development of the subject property shall substantially conform to the conceptual plan included as part of the file for Case No.PZ-97- 26. 2.All construction associated with this proposal shall comply with the Uniform Building Code,and all other applicable codes and standards as adopted by the City of Apache Junction. ORDINANCE 1033 PAGE ONE OF THREE 3.The layout of the site shall be redesigned to meet all requirements of the Apache Junction Fire District,and the City's Engineering Department.All requirements of the City of Apache Junction,and other applicable agencies shall be fully satisfied. 4.A waiver is to be granted allowing the perimeter fence to be located in the front setback area in accordance with the conceptual plan. 5.No more than 50% of the required front setback area can be used for retention,per Ordinance 940. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase,clause or portion of this ordinance or any part of the Code adopted herein by reference is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
