AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION.ARIZONA.ZONING
ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP.CITY OF APACHE
JUNCTION.ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN
REZONING CASE PZ-4-98 FROM CI -1 (LIGHT INDUSTRY AND WAREHOUSE
ZONE)TO CI-2/PD (HEAVY INDUSTRIAL BY PLANNED DEVELOPMENT),FOR
THE SPECIFIC PURPOSE OF DEVELOPING A STEEL STRUCTURES FABRICATION
PLANT;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR
SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
THAT:
SECTION I IN GENERAL
The zoning district classification on the Zoning District Map.City of Apache
Junction.Arizona,for the parcel of land described as:
The West 370 feet of the South half of the Northeast quarter of
the Southwest quarter of Section 33,Township 1 North,Range 8
East of the Gila and Salt River Base and Meridian,Pinal County,
Arizona;
be and hereby is amended from CI -1 (Light Industry and Warehouse Zone)to CI-
2/PD (Heavy Industrial by Planned Development),subject to the following
conditions:
1)The site shall be developed in substantial conformance with the
preliminary Planned Development plans (including the landscape concept,
color pallette and wall detail)and elevations submitted.
2)The location and construction of temporary accessways and driveways
shall be constructed according to City Engineer and Fire District
specifications.

3)The property owners (Nichols)and/or the developer (Metaltrade,Inc.)
shall be responsible for providing for on -site water retention for the
site;and for constructing,to the City Engineer's standards,S.
Winchester Road,from E.Baseline Avenue to the gross northwest corner
of the subject site,and E.34°Avenue along the site's north frontage,
according to the preliminary subdivision plat for Baseline Industrial
Park approved by Resolution No.97-45,if the final plat for said
subdivision has not been submitted to the Planning Division at the time
of building permit issuance for Metaltrade,Inc.
4)As part of the final improvement and Planned Development plans,the
developer shall provide a landscape plan for the subject site.Along
the property's west frontage,said landscape plan shall exceed the
provisions of Ordinance No.940 -Landscape and Screening Standards,
insofar as density,maturity of plants,extra depth for landscape area,
etc.,to be coordinated with and approved at the discretion of the
city's Parks and Recreation Department and Planning Division.Said
landscape plans may include,but not necessarily be limited to,
screening walls,possible retention areas and landscape berms for
functional,security and aesthetic purposes.
5)The property shall be developed within 24 months of rezoning approval or
else the zoning may be subject to reversion to its former classification
by City Council legislative action pursuant to Arizona Revised Statutes
Annotated (A.R.S.)§9-462.01.
6)Any use or development of said property may be conditioned upon the
provisions of Article 19 of the Zoning Ordinance.The provisions of the
Uniform Building Code and all other City Codes,policies,guides and
standards shall apply and control all design and construction of
improvements.
7)All construction shall be done in compliance with all applicable codes
and ordinances,including the City of Apache Junction Zoning Ordinance,
the Uniform Building Code and the Uniform Fire Code (including,but not
limited to,the provision of fire apparatus access roads,the marking of
fire lanes and the provision of adequate water supplies,sprinkler
systems and fire hydrants).

SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference is for any
reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction,such decision shall not affect the validity of the
remaining portions thereof.
