AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,ALLOWING A MAJOR AMENDMENT TO AN EXISTING
PLANNED DEVELOPMENT DESIGNATION,CASE NO.PZ-98-07,FOR THE
DEVELOPMENT OF A MANUFACTURED HOME PARK TO BE CALLED SUPERSTITION
FALLS MANUFACTURED HOME PARK, LOCATED AT THE NORTHEAST CORNER OF
SOUTH GOLDFIELD ROAD AND EAST BASELINE AVENUE;BY REPLACING
ORDINANCE NO. 1027B, AND ADOPTING IN LIEU THEREOF ORDINANCE NO.
1041;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR
SEVERABILITY
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION, ARIZONA, THAT:
SECTION I IN GENERAL
The zoning district classification on the Zoning District Map, City
of Apache Junction, Arizona,for the parcel of land described as:
The Southwest quarter of Section 35, Township 1 North,
Range 8 East,of the Gila and Salt River Base and
Meridian, Pinal County, Arizona.
is Trailer Homesite by Planned Development (TH/PD); and
The existing zoning designation was assigned to the parcel upon
annexation into the City of Apache Junction in July of 1995, as
outlined in Ordinance 929; and
The planned development designation is amended, as requested in
Case No. PZ-98-07, to allow the development of Superstition Falls
Manufactured Home Park,subject to the following conditions
originally contained in Ordinance 1027B:
1.The development is to substantially conform to conceptual
plan as provided in the case file.
2.The construction,placement and installation of the
manufactured homes within Superstition Falls Manufactured
Home Park shall comply with the Federal Housing and Urban
Development (HUD)Building Standards;all other
improvements to Superstition Falls Manufactured Home
Park, including the clubhouse and other on site

construction shall comply with the Uniform Building Code,
and all other applicable codes and standards as adopted
by the City of Apache Junction.
3.All requirements of the City of Apache Junction and other
applicable agencies shall be met.This shall include,
but not be limited to, the dedication of an additional 50
feet of right-of-way for both Baseline Avenue and
Goldfield Road,as required by the City's Engineering
Department.
4.An application requesting the rezoning of the 21.08 +/-
acres, from TH/PD to a commercial by planned development
designation,located at the northwest corner of the
project [identified as "Not a part" on the conceptual
plan],shall be submitted to Development Services no
later than March 2, 1998.
5.The manufactured home units placed in the park shall have
an exterior vinyl finish and asphalt roof treatment.All
accessory structures,additions,and awnings/carports
shall be of similar construction as the main unit, and
shall complement the exterior as featured on the main
unit.
6.The owner of Superstition Falls Manufactured Home Park
will ensure that diversity in the appearance of the
manufactured homes will exist by offering a variety of
siding and trim color packages for the manufactured home
units, and will regulate the location of such colors so
that a "monotonous or uniform" color scheme does not
exist throughout the park.
7.The color palate shall consist of earth tones that are
complementary to the native vegetation and landscape of
the area.All colors are to be of muted hues.
8.The owner of Superstition Falls Manufactured Home Park
shall ensure that the color of the roof treatment shall
vary throughout the park by providing at least three
different roof colors for utilization throughout the
project ensuring that a monotony or "sea" of uniformity
does not exist by varying the colors in a reasonable
manner throughout the park.

9.Disturbance of the subject property shall be kept to
a minimum. Due to the location of the subject property,
high visibility of the site and environmental concerns
the following measures shall be followed during the
build -out of the site:
A.A grading and site preparation schedule shall be
prepared in a manner intended to minimize the amount of
soil disturbance that will occur at any one time.The
schedule will be submitted to the Development Services
Department and Engineering Department for review and
approval prior to any grading or site preparation on the
property.
B.Salvaging of native vegetation shall be completed in
accordance with the Plant Salvage Specifications utilized
by the City's Parks and Recreation Department.A native
plant salvage/re-vegetation plan will be required as a
component of the building permit application.
C.The retention/drainage areas shall be landscaped in
accordance with Ordinance 940, Landscaping and Screening
Requirements, prior to the issuance of any manufactured
home permits.
D.A re -vegetation seed mix shall be applied to any
areas that have been disturbed during site preparation
but are not included in the current phase of development.
Additional conditions of approval associated with Case No. PZ-98-07
are as follows:
10.All conditions of approval approved in association with
Case No.PZ-97-30 must be met,to include Ordinance
1027B.
11.Prior to submitting the building permit application, the
site plan be redesigned to provide a secondary point of
access into the proposed manufactured home park, south of
the proposed commercial area,to be aligned with the
existing main entrance into the Golden Vista RV
Subdivision.
12.The property line between the commercial property and
manufactured home park will be located in the middle of
the natural wash.The owner of the manufactured home

park and the owner of the commercial property will
execute and record a reciprocal use,access,and
maintenance agreement to maintain the natural character
and water flow in the wash area.
13.The subject property must be substantially developed
within a 24 -month period from the date of the City
Council approval of the major planned development
amendment which was Case No. PZ-98-07.If not, reversion
of the planned development amendment may be considered by
the City Council, pursuant to the provisions of Arizona
Revised Statutes Annotated §9-462.01(E).
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the
provisions of this ordinance or any part of the code adopted herein
by reference are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, phrase, clause or portion of
this ordinance or any part of the Code adopted herein by reference
is for any reason held to be invalid or unconstitutional by any
court of competent jurisdiction, such decision shall not affect the
validity of the remaining portions thereof.
