AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION, ARIZONA, AMENDING THE APACHE JUNCTION, ARIZONA, ZONING
ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP, CITY OF APACHE
JUNCTION, ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN
REZONING CASE NO. PZ-98-08 FROM TH/PD (TRAILER HOMESITES BY
PLANNED DEVELOPMENT) TO C-3/PD (GENERAL COMMERCIAL BY PLANNED
DEVELOPMENT) FOR THE PURPOSE OF DEVELOPING A COMMERCIAL SHOPPING
CENTER; REPEALING ANY CONFLICTING PROVISIONS; AND PROVIDING FOR
SEVERABILITY
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION, ARIZONA, THAT:
SECTION I IN GENERAL
The zoning district classification on the Zoning District Map,
City of Apache Junction, Arizona,for the parcel of land
described generally as:
A 21 +/- acre portion of the Southeast quarter of
Section 20, Township 1 North, Range 8 East, Gila and
Salt River Base and Meridian, Pinal County, Arizona.
be and hereby is amended from TH/PD (Trailer Homesites by Planned
Development) to C-3/PD (General Commercial by Planned Develop-
ment); subject to the following stipulations:
1.The property line between the commercial property and
manufactured home park will be located in the middle of
the natural wash.The owner of the manufactured home
park and the owner of the commercial property will
execute and record a reciprocal use, access and
maintenance agreement to maintain the natural character
and water flow in the wash area.
2.The subject property must be substantially developed
within a 24 -month period from the date of the City
Council decision on the rezoning request as outlined in
Case No. PZ-98-08.If not, reversion of the C-3/PD
zoning designation may be considered by the City
Council, pursuant to the provisions of Arizona Revised
Statutes Annotated §9-462.01(E).

3.Major amendments to the planned development designation
will be processed as specific end -users are identified.
4.A master signage proposal, addressing freestanding and
directional signs for the entire parcel, will be
submitted with the first amendment request for this
site.
5.All requirements of Article 19. Planned Developments,
of the Zoning Ordinance will be met.
6.Requirements of Ordinance No. 940,Landscaping and
Screening Requirements,will be met.
7.All requirements of the City of Apache Junction, and
other applicable agencies, will be met.This will
include, but not be limited to, the dedication of 50
feet of right-of-way for Goldfield Road, as required by
the City's Engineering Department.
8.Disturbance of the subject property shall be kept to a
minimum.Due to the location of the subject property,
high visibility of the site, and environmental concerns
the following measures shall be followed during the
build -out of the site:
A.A grading and site preparation schedule shall be
prepared in a manner intended to minimize the
amount of soil disturbance that will occur at any
one time.The schedule will be submitted to the
Development Services Department and Engineering
Department for review and approval prior to any
grading or site preparation on the property.
B.Salvaging of native vegetation shall be completed
in accordance with the Plan Salvage Specifications
utilized by the City's Parks and Recreation
Department.A native plan salvage/re-vegetation
plan will be required as a component of the
building permit process.
C.The retention/drainage areas shall be landscaped
in accordance with Ordinance 940, Landscaping and
Screening Regulations, prior to the issuance of
any permits allowing vertical construction.

D.A re -vegetation seed mix shall be applied to any
areas that have been disturbed during site
preparation but are not included in the current
phase of development.
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the
provisions of this ordinance or any part of the code adopted
herein by reference are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, phrase, clause or portion
of this ordinance or any part of the Code adopted herein by
reference is for any reason held to be invalid or
unconstitutional by any court of competent jurisdiction, such
decision shall not affect the validity of the remaining portions
thereof.
