AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,ALLOWING A MAJOR AMENDMENT TO AN EXISTING
PLANNED DEVELOPMENT DESIGNATION,CASE NO.PZ-98-13,FOR THE
DEVELOPMENT OF THE FRY'S SHOPPING CENTER, GENERALLY LOCATED AT THE
SOUTHEAST CORNER OF PHELPS DRIVE AND APACHE TRAIL; REPEALING ANY
CONFLICTING PROVISIONS; AND PROVIDING FOR SEVERABILITY
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION, ARIZONA, THAT:
SECTION I IN GENERAL
The zoning district classification on the Zoning District Mae. City
of Apache Junction. Arizona,for the parcel of land described as:
A portion of the Southeast quarter of Section 20,
Township 1 North, Range 8 East of the Gila and Salt River
Base and Meridian, Pinal County Arizona.
is General Commercial by Planned Development (C-3/PD); and
The planned development designation is amended,as requested in
Case No.PZ-98-13,approving a new conceptual plan and altered
building orientations , subject to the following conditions:
1.The Fry's Shopping Center will be developed in accordance
with the revised conceptual plan as found in the files of
Case No. PZ-98-13.
2.All requirements of Ordinance No.1021 remain in full
force.
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the
provisions of this ordinance or any part of the code adopted herein
by reference are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, phrase, clause or portion of
this ordinance or any part of the Code adopted herein by reference
is for any reason held to be invalid or unconstitutional by any

court of competent jurisdiction, such decision shall not affect the
validity of the remaining portions thereof.
