HomeMy WebLinkAboutORD1059ORDINANCE NO.1059 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION.ARIZONA.ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP.CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-98-18 FROM CR-1 (CONVENTIONAL SINGLE-FAMILY HOMES ON 20.000 -NET SQUARE FOOT MINIMUM LOTS)TO CR-2 (CONVENTIONAL SINGLE-FAMILY HOMES ON 11.000 -NET SQUARE FOOT MINIMUM LOTS IN APPROVED SUBDIVISIONS):REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the ZONING DISTRICT MAP,CITY OF APACHE JUNCTION.ARIZONA,for the parcel of land described as: The North half of the Northeast quarter of the Southwest quarter of the Northwest quarter of Section 28.Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona: be and hereby is amended from CR-1 (conventional single-family homes on 20,000 -net square foot minimum lots)to CR-2 (conventional single-family homes on 11,000 -net square foot minimum lots in approved subdivisions),subject to the following stipulations: 1)The Final Plat must be approved within a 24 -month period,from the date of City Council approval of the rezoning request to CR-2.If not, the zoning on the property may be subject to reversion to the original zoning classification by City Council action,pursuant to the provisions of Arizona Revised Statutes Annotated (A.R.S).§ 9-462.01. 2)The Preliminary and Final Plat must conform to all requirements of the proposed zoning district (CR-2),including a minimum 80 -foot lot width,and all other applicable regulations that apply to such property. ORDINANCE NO.1059 PAGE 1 OF 2 3)All open spaces must be maintained through either 1)a Home Owner's Association,as part of the adjacent residential lot or through a deed restriction for that property owner to maintain,by the developer (Gene Wilson).his heirs,assigns,successors in interest,etc.,2)or other arrangement that legally binds an entity or individual(s)to the perpetual maintenance of the open spaces/retention areas prior to Final Plat submittal. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
