AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY
CODE,CHAPTER 7,BUILDING,BY AMENDING ARTICLE 7-1,BUILDING
CODES AND CONSTRUCTION STANDARDS BY ADDING NEW SUBSECTION
"I"TO SECTION 7-1-2,BUILDING CODES;AMENDMENTS,RELATING
TO THE WAIVER OF CERTAIN FEES FOR SCHOOL DISTRICTS UPON
MEETING SPECIFIED CRITERIA;PROVIDING FOR SEVERABILITY;AND
DECLARING AN EMERGENCY
WHEREAS,the City of Apache Junction recognizes that the joint use
of certain publicly -funded facilities would benefit the general public;
and
WHEREAS,the joint use of such facilities would provide a
financial benefit to the city and justify the waiver of certain fees
charged by the city.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF APACHE JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I .IN GENERAL
That a new subsection (I)to Section 7-1-2 Building Code;Amendments,of
the Apache Junction City Code be added to read as follows:
Section 7-1-2 Building Code;Amendments
I.Subject to the criteria set forth below,the City Manager or
designee thereof,may waive all or part of any building
permit,development,and/or grading fees which are imposed
on any person,currently in effect or enacted in the future,
for the construction of any structure in the corporate
limits of the city:
(a)Incorporation of greater community access into the
design and construction of new schools;

(b)Use of multi -purpose rooms such as cafeterias,
libraries and playing fields by the general public;
and
(c)Allowing the construction of extra rooms and
facilities on school sites where such construction is
financed and owned by the city for community use.
SECTION II.REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions
of this ordinance or any part of the code adopted herein by reference
are hereby repealed.
SECTION III.PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,clause,phrase or portion of this
ordinance or any part of the code adopted herein by reference is,for
any reason,held to be invalid or unconstitutional by any court of
competent jurisdiction,such decision shall not affect the validity of
the remaining portions thereof.
SECTION IV.DECLARING AN EMERGENCY
It being necessary for the preservation of the peace,health and safety
of the City of Apache Junction,Arizona,that this ordinance become
effective immediately,an emergency is declared to exist and this
ordinance shall be effective immediately upon its passage and adoption.
