HomeMy WebLinkAboutORD1069ORDINANCE NO.1069 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,APPROVING A MAJOR AMENDMENT TO AN EXISTING PLANNED DEVELOPMENT DESIGNATION FOR THE DEVELOPMENT OF A MEDICAL TREATMENT CAMPUS AT THE NORTHEAST CORNER OF SOUTH OCOTILLO DRIVE AND WEST SOUTHERN AVENUE;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map.City of Apache Junction,Arizona,for the parcel of land described as: COMMENCING at the South quarter corner of said Section 30: THENCE North 89 degrees 53 minutes 26 seconds East along the South line of the Southeast quarter of said Section 30,a distance of 668.00 feet to a point,said point being the TRUE POINT OF BEGINNING. THENCE North 00 degrees 03 minutes 01 seconds West,a distance of 270.00 feet to a point: THENCE North 89 degrees 53 minutes 26 seconds East,a distance of 652.78 feet to a point on the East line of the West half of the Southeast quarter of said Section 30; THENCE South 00 degrees 03 minutes 15 seconds East along said line, a distance of 270.00 feet to a point on the South line of the Southeast quarter of said Section 30; THENCE South 89 degrees 53 minutes 26 seconds West along last said line,a distance of 652.79 feet to the TRUE POINT OF BEGINNING. ORDINANCE NO.1069 PAGE ONE OF THREE currently zoned as C-2/PD (Local Commercial by Planned Development),hereby is amended to allow the development of a convenience store with car wash and petroleum pumps,subject to the following conditions: 1.The development of the subject 3.3 acres shall conform to all requirements of the City of Apache Junction,and applicable agencies,with regard to development requirements and standards. 2.Development of this project will comply with the Uniform Building Code and any and all other applicable standards as adopted by the City of Apache Junction. 3.The site will be developed in substantial conformance to the conceptual plan and elevation submitted by the applicant as a matter of public record contained in Department of Development Services Case File PZ-98-23. 4.All applicable development fees are due and payable upon the issuance of the building permit for this site. 5.The subject property shall be developed within 24 months of the date of the rezoning approval [June 26,19971,or the zoning may revert to its former classification in accordance with the Apache Junction City Code,Vol.II,Land Development Code,Chapter 1,Zoning Ordinance,Article 19,Section 19.0111.4. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase,clause or portion of this ordinance or any part of the Code adopted herein by reference is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
