AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE BY
AMENDING ARTICLE 10-1 OFFENSES -GENERAL BY AMENDING SECTION 10-1-29
TRUANCY;PROVIDING FOR PENALTIES;PROVIDING FOR SEVERABILITY;AND
DECLARING AN EMERGENCY
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I .IN GENERAL
That Section 10-1-29 Truancy of the Apache Junction City Code be amended to
read as follows:
Section 10-1-29 Truancy
A."Truancy"means the unexcused absence of any child age six to
sixteen from any school.The occurrence of five unexcused
absences of any child age six to sixteen during a school year
shall raise a presumption that the child was truant and in
violation of this section.
B."Truant"means an unexcused absence for at least one class period
during the day.
C."Unexcused absence"means an absence that within twenty-four hours
after i t has occurred has not been authorized by the parents,
guardian,or any person having legal custody of any pupil age six
to sixteen enrolled in a school.I t shall be presumed that an
absence is an unexcused absence for purposes of this section upon
the failure of the parents,guardian or any person having legal
custody of any pupil age six to sixteen enrolled in a school to
contact the school and authorize the absence within twenty-four
hours after the absence.
That all subsequent subsections of Section 10-1-29 of the Apache Junction City
Code be renumbered to conform.

SECTION II.REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III.PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,clause,phrase or portion of this
ordinance or any part of the code adopted herein by reference is for any
reason held to be invalid or unconstitutional by a decision of any court of
competent jurisdiction,such decision shall not affect the validity of the
remaining portions thereof.
SECTION IV.EMERGENCY CLAUSE
I t being necessary for the peace,health and safety of the City of Apache
Junction,Arizona,an emergency is declared to exist and this ordinance shall
be effective immediately upon its passage and adoption.
