AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY
CODE,VOL.II,LAND DEVELOPMENT CODE,CHAPTER 1 ZONING
ORDINANCE,ARTICLE 6 GENERAL PROVISIONS AND EXCEPTIONS,
SECTION 6.0101(2)(b)CONDITIONAL USE PERMITS;ARTICLE 12
PROCEDURE FOR VARIANCE,SECTION 12.0101(d)APPLICATION;
ARTICLE 13 ZONING ORDINANCE AMENDMENTS AND CHANGES,SECTION
13.0103 FILING FEES;CHAPTER 2 SUBDIVISION REGULATIONS,
ARTICLE 3 ADMINISTRATIVE SUBDIVISIONS -LAND SPLITS,SECTION
3.07.04(2)APPLICATION REQUIREMENTS;ARTICLE 6
ADMINISTRATION,SECTION 6.03(1)FILING FEES;REPEALING ANY
CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
That the Apache Junction City Code,Vol.II,Land Development Code,Chapter 1
Zoning Ordinance be amended by deleting the reference to fees for conditional
use permits,zoning variances,rezoning,plan amendments and case
continuances;and Chapter 2 Subdivision Regulations be amended by deleting the
reference to fees for land splits,preliminary plat,final plat and
recordation to read as follows:
A.CHAPTER 1 ZONING ORDINANCE,ARTICLE 6 GENERAL PROVISIONS AND EXCEPTIONS
SECTION 6.0101 Conditional Use Permits,paragraph 2 is amended to read:
b.Fees for conditional use permits,a major amendment to a conditional
use permit,a time extension request for a conditional use permit,a
continuance of a case requested by the applicant,and a review and
letter of non -conforming use are listed in the Apache Junction City
Code,Vol.I,Chapter 4 Fees.
B.CHAPTER 1 ZONING ORDINANCE,ARTICLE 12 PROCEDURE FOR VARIANCE
SECTION 12.0101 Application,paragraph "d"is amended to read:

Filing fees for applications to the Board of Adjustment for an appeal of
a decision of the Zoning Administrator,a variance involving a single-
family dwelling,a variance involving uses more intensive than one
single-family dwelling,and a continuance of a case requested by the
applicant are listed in the Apache Junction City Code,Vol.I,Chapter 4
Fees.
C.CHAPTER 1 ZONING ORDINANCE,ARTICLE 13 ZONING ORDINANCE AMENDMENTS AND
CHANGES
SECTION 13.0103 Filing Fees is amended to read:
Fees for rezoning to a single-family residential classification on a
site 1.25 gross acres or less,rezoning to a single-family residential
classification on a site greater than 1.25 gross acres,rezoning to
commercial,industrial,or multi -family,rezoning to a Planned
Development,General Plan amendment,major amendment to a Planned
Development,continuance of a case at request of applicant,and time
extension are listed in the Apache Junction City Code,Vol.I ,Chapter 4
Fees.
D.CHAPTER 2 SUBDIVISION REGULATIONS,ARTICLE 3 ADMINISTRATIVE SUBDIVISIONS -
LAND SPLITS
SECTION 3.07.04 Application Requirements,paragraph 2 is amended to read:
2.Fees for an application for a land split are listed in the Apache
Junction City Code,Vol.I ,Chapter 4 Fees.
E.CHAPTER 2 SUBDIVISION REGULATIONS,ARTICLE 6 ADMINISTRATION
SECTION 6.03 Filing Fees,paragraph 1 is amended to read:
1.Fees for an application for plat approval for preliminary plat,final
plat,amendment to final plat and recordation are listed in the Apache
Junction City Code,Vol.I ,Chapter 4 Fees.

SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference is for any
reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction,such decisions shall not affect the validity of the
remaining portions thereof.
