AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE,VOLUME
II,LAND DEVELOPMENT CODE,CHAPTER 1,ZONING ORDINANCE,BY
AMENDING THE ZONING DISTRICT MAP.CITY OF APACHE JUNCTION.
ARIZONA.CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING
CASE PZ-22-98 FROM GR (GENERAL RURAL)TO C-3/PD (GENERAL
COMMERCIAL BY PLANNED DEVELOPMENT);REPEALING ANY CONFLICTING
PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
The zoning district classification on the Zoning District Map.City of Apache
Junction.Arizona,for the parcel of land described as:
The North half of the West half of the West half of the Northwest
quarter of the Northeast quarter of Section 29,Township 1 North,
Range 8 East of the Gila and Salt River Base and Meridian,Apache
Junction,Pinal County,Arizona;
be and hereby is amended from GR (General Rural)to C-3/PD (General Commercial
by Planned Development),subject to the following conditions of approval:
1)The final planned development plans for the neighborhood commercial
center shall be developed according to the Site Plan "B"and elevations
presented on the preliminary planned development plans,a copy of which
is on file in the Development Services Department,Planning Division.
2)Permitted uses in the neighborhood commercial center shall include:
craft or hobby shop,barber or beauty shop,delicatessen,pizza
restaurant,convenience store (except in the main strip center
building),real estate office,eye doctor,chiropractor,laundromat,
office supply store,photocopy store,photography studio,book or music
store,bakery,florist,furniture store,sporting goods store,shoe
store,veterinarian,pet shop,fitness studio and jeweler.Any other
uses which may be permitted are limited to those which are of equal or
no greater intensity than those permitted in this section.Prohibited

businesses include filling stations,ambulance services,pawn shop,
automotive or transmission repair and any industrial.
3)Approval of the preliminary planned development plans incorporates by
reference any requested deviations from standard zoning requirements,as
set forth in the Apache Junction City Code,Volume II,Land Development
Code,Chapter 1,Zoning Ordinance,including requested deviations from
setbacks,landscape strips and a reduction in the standard parking space
size from 9 feet by 20 feet,to 9 feet by 18.5 feet for parking spaces
fronting on sidewalks or overhanging onto landscaped areas.
4)The property owners shall dedicate and/or improve to the City Engineer's
standards any necessary rights -of -way,including,but not limited to,
the North 50 feet for Broadway,the West 40 feet for San Marcos,and any
necessary cutoff corners.Said improvements shall include the provision
of curbs,gutters,sidewalks,driveways,streetlights,pavement
widening,retention basins and other reasonable improvements required
by the City Engineer.
5)The property owners shall develop and submit,pursuant to the Apache
Junction City Code,Volume II,Land Development Code,Chapter 6,Article
6-1 Landscaping and Screening Requirements,landscape plans subject to
approval by the Parks and Recreation Department and the Planning
Division,during the building permit process.
6)The property shall be developed within 24 months of rezoning approval or
the City Council may take legislative action to revert the zoning to its
former classification according to the Apache Junction City Code,Volume
II,Land Development Code,Chapter 1,Zoning Ordinance,Article 19
Planned Development Zoning District.
7)All construction shall be done in compliance with all applicable codes
and ordinances as adopted in the Apache Junction City Code,Volume II,
including,but not limited to,the Zoning Ordinance and other
regulations,such as the Uniform Building Code,Engineering Guidelines
and the Uniform Fire Code.(The Uniform Fire Code regulations may
include fire apparatus access roads,the marking of fire lanes and the
provision of adequate water supplies,sprinkler systems and fire
hydrants).
8)The developers shall pay all applicable development fees prior to the
issuance of building permits.

SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance,or any part of the code adopted herein by reference,are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference,is for any
reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction,such decision shall not affect the validity of the
remaining portions thereof.
