AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION.ARIZONA,ZONING
ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP.CITY OF APACHE
JUNCTION.ARIZONA.CHANGING THE ZONING DISTRICT CLASSIFICATION IN
REZONING CASE PZ-6-99 FROM CR-5 (MULTIPLE -FAMILY
RESIDENCES/APARTMENTS)TO CR-5/PD (MULTIPLE -FAMILY OR CONVENTIONAL
SINGLE-FAMILY RESIDENCES BY PLANNED DEVELOPMENT);REPEALING ANY
CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
The zoning district classification on the Zoning District Map.City of Apache
Junction.Arizona,for the parcels of land described as:
Lot 1412 and Lot 1413,Palm Springs Subdivision,Unit 14,according
to the plat of record in the office of the County Recorder of Pinal
County,Arizona,in Book 14 of Maps,Page 8;
be and hereby is amended from CR-5 (Multiple -Family Residences/Apartments)to CR-
5/PD (Multiple -Family or Single -Family Residences by Planned Development),
subject to the following conditions of approval:
1)The general requirements of the Apache Junction City Code,Volume II,Land
Development Code,Chapter 1 Zoning Ordinance,Article 19 Planned
Development Zoning District are hereby waived for the subject lots,and
the following modified standards for the subject lots and the existing
homes shall be required in lieu thereof.
2)Minimum Building setbacks shall be:Front -25 feet;Rear -25 feet;
Sides -7 feet.
3)All other applicable provisions of Planning and Zoning Commission Resol-
ution No.CUP -97-07,a copy of which is on file with the Apache Junction
City Clerk's Office,shall remain in full force and effect.
4)All construction shall be done in compliance with all applicable codes
and ordinances as adopted in the Apache Junction City Code,Volume II,
ORDINANCE NO.1090

including,but not limited to,the Zoning Ordinance,the Uniform Build-
ing Code,Engineering Guidelines and the Uniform Fire Code.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance,or any part of the code adopted herein by reference,are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference,is for any reason
held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portions thereof.
