HomeMy WebLinkAboutORD1001ORDINANCE NO.1001 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION.ARIZONA.ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP.CITY OF APACHE JUNCTION.ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE NO.PZ-97-10,FOR A 23.38 ACRE PARCEL,FROM CR-3 (SINGLE-FAMILY RESIDENTIAL,7000 SQUARE FOOT MINIMUM LOT SIZE,CONVENTIONAL CONSTRUCTION ONLY)TO CR-3/PD (SINGLE-FAMILY RESIDENTIAL, 7000 SQUARE FOOT MINIMUM LOT SIZE,CONVENTIONAL CONSTRUCTION ONLY BY PLANNED DEVELOPMENT)FOR AN AREA CONSISTING OF 20.08 ACRES FOR THE PURPOSE OF DEVELOPING A 96 -LOT SUBDIVISION,AND C-2/PD (LOCAL COMMERCIAL BY PLANNED DEVELOPMENT)FOR AN AREA CONSISTING OF 3.3 ACRES FOR THE PURPOSE OF DEVELOPING THE SITE WITH PROFESSIONAL AND/OR MEDICAL SUPPORT ACTIVITIES COMPLEMENTARY TO THE EXISTING CASA BLANCA MEDICAL CLINIC AND APACHE JUNCTION HEALTH CENTER; REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map.City of Apache Junction.Arizona,for the parcels of land described as: The West half of the Southeast quarter of Section 30,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian, Pinal County,Arizona; EXCEPTING THEREFROM the South 150 feet of the West 150 feet thereof; ALSO EXCEPTING THEREFROM the South 208.7 feet of the East 208.7 feet of the West 358.7 feet thereof; ALSO EXCEPTING all uranium,thorium or other materials which are or may be determined to be peculiarly essential to the produc- tion of fissionable materials,as reserved in the Patent recorded in Docket 10,page 33. ORDINANCE NO.1001 PAGE ONE OF THREE be and hereby is amended from CR-3 (Single -Family Residential,7000 square foot minimum lot size,conventional construction only)to CR-3/PD (Single- Family Residential,7000 SQFT minimum lot size,conventional construction only,by planned development)for an area consisting of 20.08 acres and C-2/PD (Local Commercial by Planned Development)for an area consisting of 3.3 acres; subject to the following stipulations: 1.The subject property shall be developed within 24 months of rezoning approval or the zoning may revert to its former classification in accordance with Section 19.0111.4 of the Zoning Ordinance. 2.All development and/or use requirements as indicated in Article 12,Planned Development of the Zoning Ordinance will be satisfied.The provisions of the Uniform Building Code and all other City Codes,policies,guides and standards shall apply and control all design and construction of improvements. 3.Development of this project will comply with the Uniform Building Code and all other applicable standards as adopted by the City of Apache Junction. 4.The 3.3 acres being rezoned to C-2/PD shall be developed with professional and/or medical support activities complementary to the existing Casa Blanca Medical Clinic and Apache Junction Health Center. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase,clause or portion of this ordinance or any part of the Code adopted herein by reference is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
