HomeMy WebLinkAboutORD1002ORDINANCE NO.1002 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION.ARIZONA.ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP.CITY OF APACHE JUNCTION.ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE NO.PZ-97-12,FOR A 1.82 ACRE PARCEL, FROM GR (GENERAL RURAL,1.25 ACRE MINIMUM PARCEL SIZE,SINGLE FAMILY RESIDENTIAL,CONVENTIONAL OR MANUFACTURED HOMES ALLOWED)TO TH (TRAILER HOMESITE,20,000 SQFT MINIMUM PARCEL SIZE)FOR THE PURPOSE OF COMBINING THE 1.82 ACRE PARCEL WITH THE EXISTING LOST DUTCHMAN RV PARK IN ORDER TO REDESIGN THE MAIN ENTRANCE TO THE PARK AND PROVIDE ADDITIONAL RECREATIONAL FEATURES TO THE PARK RESIDENTS;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map.City of Apache Junction,Arizona,for the parcels of land described as: The Northeast quarter of Section 20,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona, described as follows: BEGINNING at the intersection of the West right-of-way line of Lost Dutchman Boulevard (Plaza Drive),and the North line of a certain parcel of land recorded in Docket 382,Page 572,Records of Pinal County, Arizona: THENCE,North 89 degrees 55 minutes 47 seconds West along said North line 298.70 feet; THENCE.North 00 degrees 04 minutes 15 seconds East 270.00 feet: ORDINANCE NO.1002 PAGE ONE OF THREE THENCE,South 89 degrees 55 minutes 47 seconds East 298.70 feet to a point on the West right-of-way line of Lost Dutchman Boulevard; THENCE,South 00 degrees 04 minutes 15 seconds West along said right-of- way line 270.00 feet to the POINT OF BEGINNING be and hereby is amended from GR (General Rural,single-family residential, 1.25 acre minimum parcel size,conventional or manufactured housing allowed) TO TH (Trailer Homesite,20,000 SOFT minimum parcel size):subject to the following stipulations: 1.The subject property will be combined with the existing Lost Dutchman RV Park via the Pinal County Assessor's Office,prior to any work being done to accomplish the relocation of the main entrance to said park. 2.Development of the subject property will substantially conform to the site plan as submitted with the application for rezoning,Case No.P7-97-12. 3.Development of the subject property will comply with the Uniform Building Code and all other applicable standards as adopted by the City of Apache Junction. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase,clause or portion of this ordinance or any part of the Code adopted herein by reference is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
