HomeMy WebLinkAboutORD1006ORDINANCE NO.1006 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-16-97 FROM GR (GENERAL RURAL)TO C- 1/PD (NEIGHBORHOOD COMMERCIAL/CONVENIENCE DISTRICT BY PLANNED DEVELOPMENT); REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,for the parcel of land described as: That part of the North half of the Northeast quarter of the Northwest quarter of the Southwest quarter of Section 27,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona; lying south of Old West Highway. be and hereby is amended from GR (General Rural)to C-1/PD (Neighborhood Commercial/Convenience District by Planned Development)in order to allow the development of a medical clinic and another commercial pad,subject to the following stipulations: 1)The medical clinic shall be developed per the basic site plan and elevations shown on the submitted preliminary site plan,with the recommended minor modifications as contained in the PZ-16-97 Planning and Zoning staff report. 2)The medical clinic shall be allowed on -site signage as permitted for uses in commercial districts.No off -site signage is allowed. 3)The medical clinic shall be operated in compliance with all state and federal guidelines. 4)The clinic shall not be constructed until sewer service is available to the site or unless septic tanks or other solutions are permitted by the Arizona Department of Environmental Quality and the Pinal County Health Department. 5)The property owners shall develop and submit landscape plans per the provisions of Ordinance No.940,subject to approval by the Parks and Recreation Department and the Planning Division,during the building permit process. ORDINANCE NO.1006 PAGE 1 OF 3 6)Proposed future commercial uses on the undeveloped part of the Planned Development property shall be subject to Planning Division and Zoning Administrator approval. 7)The property owners shall dedicate and improve to the City Engineer's standards any necessary right-of-ways,as determined by the City Engineer, including but not necessarily limited to,the south 33 feet for E.17th Avenue and possibly the east 33 feet for S.Wickiup Road (to be determined later)and any necessary cut-off corners.Said improvements may include the provision of curbs,gutters,sidewalks,driveways,streetlights, pavement widening,retention basins,drainage culverts,etc. 8)On -Site retention basins must meet City requirements for 10 -year 24 -hour storm. 9)The property shall be developed within 24 months of rezoning approval or else the zoning may revert to its former classification per Section 19.0111.4 of the Planned Development ordinance. 10)Any use or development of said property may be conditioned upon the provision of public improvements,a view fence and landscaping in accordance with the provisions of Article 19 of the Zoning Ordinance.The provisions of the Uniform Building Code and all other City Codes, policies,guides and standards shall apply and control all design and construction of improvements. 11)All construction shall be done in compliance with all applicable codes and ordinances,including the City of Apache Junction Zoning Ordinance,the Uniform Building Code and the Uniform Fire Code (including,but not limited to,the provision of fire apparatus access roads,the marking of fire lanes and the provision of adequate water supplies,sprinkler systems and fire hydrants). SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance,or any part of the code adopted herein by reference,are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
