HomeMy WebLinkAboutORD1007ORDINANCE NO.1007 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATIc .IN REZONING CASE PZ-20-97 FROM GR (GENERAL RURAL)TO --3MH (CONVENTIONAL OR MANUFACTURED SINGLE-FAMILY RESIDENCES ON PIO NET- SQUARE -FEET MINIMUM LOTS);REPEALING ANY CONFLICTING PROVI ONS; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE VITY OF APACHE t A l SECTION I IN GENERAL The zoning district classification on thWning c (trict Mal,City of Apache Junction,Arizona,for the parcel of lan escrib as: NTheSouthhalfoftheNorthwestquarter 1f the NoVast quarter of the Northeast quarter of Section 1;AND e North, h l f of the Southwest quarter of the Northeast qu050 r of t Northeavt quarter of Section 21, Township 1 North,Range 8Vast of he Gi l and Salt River Base and Meridian,Apache Juncttorx Pinal Co nty,Ar a; JUNCTION,ARIZONA,THAT: be and hereby is amended frokhR (Ge ral Rural)to CR-3MH (Conventional or Manufactured Single -Family Residences16n 7000 -net -square -feet Minimum Lots)for the purpose of developing a subdivisi n to be named Cactus Estates subject to the following stipulations: 1)The property owner shaly dedicate,for roadway,utility and other associated purposes,the est 33 feet of the 10 -acre property,and any subsequent interior str ts of the proposed Cactus Estates Subdivision,if required by the City E gineer. 2)Section 13.0111 Inificance of Alsroval Approval of rezoning constitutes author .zation for the development of property under granted zoning.Rezonin;approval is valid for a period of twenty-four (24) months from the sate of the City Council decision.I f approval expires prior to subst.ntial development upon the rezoned property,the zoning shall revert 'o its former zoning classification without legislative action.If,o later than 150 days prior to the expiration of the zoning, the proper'y owner files a request for a hearing to have the zoning extended or an additional period of time,the Planning and Zoning Commission and the City Council may consider granting the requested extension at their discretion. 3)Rezoning approval is dependent upon sewer district expansion to include and accommodate the owner's offer to connect to a line at his own expense. ORDINANCE NO.1007 PAGE 1 OF 2 SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provt#1ons of this ordinance,or any part of the code adopted herein by referenA,are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by refer nce,is for any reason held to be invalid or unconstitutional by the decision g,f any court of competent jurisdiction,such decision shall not affect the v idity of the remaining portions thereof.
