AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,CHANGING THE USE OF A TRACT THROUGH A PLANNED DEVELOPMENT MAJOR
AMENDMENT IN CASE P7-97-15 FOR THE SUNRISE RV RESORT SUBDIVISION BY AMENDING
ORDINANCE NO 190 (PZ-83-17),REPEALING ANY CONFLICTING PROVISIONS;AND
PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
THAT:
SECTION I IN GENERAL
That Ordinance No.190 be amended by adding paragraph 5 to SECTION I to read
as follows:
5.Tract C of the Sunrise RV Resort Subdivision:
a.The 17 RV lots are subject to the provisions of the Arizona
Department of Environmental Quality and all other applicable
ordinances adopted by the City to maintain public health,safety
and welfare.
b.Appropriate development and other applicable fees are due upon
issuance of the building permit for construction of the 17 RV
lots.
c.The two (2)retention basins in Tract C are desert landscaped,
the landscaping controls dust and weeds,and a landscaping plan is
prepared and submitted to the City for approval in accordance with
the submittal,retention basins,maintenance and general
requirements of the Landscaping Regulations (Ordinance No.940)
(Section 6-1-3,6-1-4,6-1-5 A,F and G.6-1-7).
d.All access be from the Broadway Avenue entrance.The Ironwood
Drive access through Tract C will be maintained as an emergency'
access only.
e.The 17 RV lots are to be developed in conformance with the
approved site plan.

f.Prior to issuance of the Certificate of Occupancy for the 17 RV
lots the City must receive proof in writing that the retention
basins and dry wells are registered with the Industrial &
Stormwater Unit of the Arizona Department of Environmental Quality
and that the usage and sanitary facilities of these 17 lots met
all the requirements from the Arizona Department of Real Estate.
g.No structures are allowed to encroach into any easements.
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference is for any
reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction,such decision shall not affect the validity of the
remaining portions thereof.
