AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA AMENDING AND CORRECTING A SCRIVENER'S ERROR IN
ORDINANCE NO.994,AS PASSED AND ADOPTED ON THE 20TH DAY OF MAY,
1997;REPEALING ANY CONFLICTING PROVISIONS:PROVIDING FOR
SEVERABILITY:AND DECLARING AN EMERGENCY.
WHEREAS,the Mayor and City Council of the City of Apache Junction.Arizona,
on May 20,1997 passed and adopted Ordinance No.994,amending the Apache
Junction.Arizona,Zoning Ordinance,by amending the Zoning District Map.City
of Apache Junction.Arizona,changing the zoning district classification in
rezoning case PZ-05-97 from GR (conventional or manufactured single-family
homes on 1.25 -acre gross minimum lots)to CR-1 MH (conventional or
manufactured single-family homes on 20,000 sq.ft.gross minimum lots):and
WHEREAS,said Ordinance No.994 is now in full force and effect;and
WHEREAS,a scrivener's error exists in the legal description contained in
Section I of said Ordinance No.994 wherein the description was described by
section and not by lot:and
WHEREAS,i t is the desire of the Mayor and the City Council of the City of
Apache Junction,Arizona to correct the scribner's error in the legal
description of the property rezoned by said Ordinance No.994:and
WHEREAS,said Ordinance No.994 is a valid ordinance of the City of Apache
Junction.Arizona and i t is the specific intent that Ordinance No.1009 shall
not affect the validity of Ordinance No.994 as passed and adopted on May 20,
1997:
SECTION I IN GENERAL
The legal description of the property rezoned by Ordinance No.994.as passed
and adopted by the Mayor and the City Council on May 20,1997.shall be
corrected and amended and to read as follows:
The South half of the West half of Lot 29.Section 18,Township 1 North,
Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,
Arizona,less the West and South 33 feet for right-of-way purposes:

SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference is for any
reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction,such decision shall not affect the validity of the
remaining portions thereof.
SECTION IV DECLARATION OF EMERGENCY
WHEREAS,i t is necessary for the preservation of the peace,health and safety
of the City of Apache Junction,Arizona,an emergency is declared to exist,
and this ordinance shall be effective upon its passage and adoption.

JUNCTION,ARIZONA.THIS 21ST DAY OF OCTOBER 1997.
