HomeMy WebLinkAboutRES 83-62RESOLUTION NO.83-62 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE ADOPTED APACHE JUNCTION,ARIZONA GENERAL PLAN ENTITLED,"APACHE JUNCTION: 2001,APACHE JUNCTION,ARIZONA,GENERAL PLAN"ADOPTED BY RESOLUTION NO.82-01 ON JULY 20,1982,AND WHICH DOCUMENT WAS MADE A PUBLIC RECORD BY ADOPTION OF RESOLUTION NO.82-48 ON JULY 20,1982,AND WHICH INCLUDES THE MAP ENTITLED, "APACHE JUNCTION,ARIZONA,2001 LAND USE MAP,"SAID AMENDMENTS AS SET FORTH HEREIN AND ON THE AMENDED "REVISED APACHE JUNCTION, ARIZONA,2001 LAND USE MAP"DATED AUGUST 30,1983. WHEREAS,on July 20,1982,the Apache Junction City Council did adopt a City General Plan entitled,"Apache Junction:2001,Apache Junction, Arizona,General Plan"by approval of Resolution No.82-01,said document being declared on the same date as a public record by passage of Resolution No.82-48;and WHEREAS,A.R.S.9-461.05(F)requires that the general plan proposal,or any amendments thereto,be circulated for at least sixty (60) days to certain stated groups,and the proposed amendments were distributed on September 14,1983 as required,the sixty (60)day review period having expired on November 14,1983;and WHEREAS,the text of the document entitled,"Apache Junction: 2001,Apache Junction,Arizona,General Plan"proposes amendments as follows: P.2-44 Add to top completing paragraph. Where low density land use areas are surrounded by other high land use densities,the one acre minimum shall not apply. Further,where there i s an existing low density zoning district that contains lots of which the minimum lot size i s less than the one acre minimum,any such former zoning district classifi- cation in affect at the time of adoption of any amendment to the land use plan may set the minimum low density lot size. P.2-44 Add paragraph above top complete paragraph. A number of residential neighborhood areas have been,and are being developed by conventional methods of housing construction. Residents of these areas have expressed a desire to continue this practice to the City Council,Planning and Zoning Commission, and staff.Therefore,zoning districts which limit residential home construction to conventional methods should only be approved by the City Council i n areas designated for "conventional construction." P.2-45 Insert in paragraph that reads: "The commercial land uses are set forth on Figure L-7.There are a number of commercial opportunity areas.Although these areas may have another main land use designation,such as residential, the 'opportunity area'designation indicates that,generally,the possibility of commercial uses should be favorably considered." I t is the intention to also allow adjacent land use designations as an option to the commercial areas."However,i t should be generally encouraged that in order for commercial rezonings to be approved,they be by Planned Development.This would regulate: 1.The amount of commercially zoned property within the City. 2.The transition between different uses by knowing the planned use or uses. 3.The on -site design through Planned Development review process. 4.The location of traffic ingress -egress points,thereby reducing the potential for safety hazards to occur." 1 RESOLUTION NO.83-62 PAGE TWO 2001 Land document, and which and which P.2-46 Add at the end of the first paragraph under the topic "Industrial." Additional Light Industrial zoning opportunity areas might be approved by the City Council along or within the commercial areas i n the vicinity of U.S.Highway 60 through Apache Junction.Such areas shall only be approved by Planned Development zoning so as to provide protection of the rights of neighboring properties,and to provide for an orderly transition;and WHEREAS,the map entitled,"Revised Apache Junction,Arizona, Use Map,'dated August 30,1983,i s declared to be a public three copies of which are on file with the Office of the City Clerk, map i s hereby incorporated,by reference,as i f set forth herein, sets forth proposed amendments to the said Land Use Map;and WHEREAS,the proposed amendments have been properly advertised and distributed,and public hearings,as required by the Arizona Revised Statutes,have been held;and WHEREAS,the general public has been afforded the opportunity to comment on the proposed Plan amendments,these comments receiving dutiful consideration;and WHEREAS,the Arizona Revised Statutes amendment of adopted general plans; NOW,THEREFORE,BE IT RESOLVED by the City of Apache Junction,Arizona,as follows: do provide for the subsequent Mayor and City Council of the 1.That certain document entitled,"Apache Junction:2001, Apache Junction,Arizona,General Plan,"i s hereby amended as set forth above in this Resolution. 2.That certain map entitled,"Revised Apache Junction,Arizona, 2001 Land Use Map,"dated August 30,1983,i s hereby adopted as the Land Use Map in the "Apache Junction:2001,Apache Junction,Arizona,General Plan."
