A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,-ARIZONA,DECLARING THAT CERTAIN FEDERALLY
PATENTED EASEMENTS FOR PUBLIC RIGHTS -OF -WAY PURPOSES ON
NORTH APACHE DRIVE FROM WEST ROUNDUP STREET' TO WEST TEPEE
STREET;WEST SHIPROCK STREET FROM 225 FEET -WEST OF -NORTH
APACHE DRIVE TO NORTH IDAHO -ROAD;AND WEST ROUNDUP STREET
FROM NORTH PLAZA DRIVE TO 165 FEET EAST OF NORTH APACHE -
DRIVE,AS DESCRIBED IN STREET ABANDONMENT CASE -AB -83-21,
ARE NO LONGER-NECESSARY FOR PUBLIC USE AS ROADWAYS AND
ARE HEREBY ABANDONED AND EXTINGUISHED AS PRESENT OR
FUTURE PUBLIC RIGHTS -OF -WAY:
WHEREAS,Mary Ann Lupo,Merl C.and Lucille H.Lehrkamp,
Robert D.and Gloria L.Copper,John F.Gore,Violet Mesich Stajmiger,
Nada M.Marcetich,Donna Mae Mesich,Shirley R.Knight,Alfred and
Norma Jean Bellucci,E.Kenneth and Elsie V.Ragan,Terry N.Willenburg,
Richard N.Mang,and Edward and Elizabeth Ginsburg have made application
for the abandonment of federally patented easements on the property
described in this Resolution;and
WHEREAS,the requested abandonments are easements for public
rights -of -way purposes described as these parcels of land located in
Section 17,Township 1 North,Range 8 East,Gila and Salt River Base
and Meridian,located in Apache Junction,Pinal County,Arizona,and
more particularly described as follows:
Parcel No.1:
The west thirty-three (33')feet of the north thirty-three
(33')feet of the North of the Northeast A of the
Southeast A of the Southeast k;and
Commencing at the east quarter corner of Section 17,Township
1 North,Range 8 East,Gila and Salt River Base and Meridian,
Pinal County,Arizona;thence south 1319.88 feet along the
east line of said Section 17;thence N89°50'00"W,462.02
feet to the true point of beginning;thence along a curve
to the left 33.63 feet,said curve having a radius of
50.00 feet,central angle of 38°32'23"and long chord
bearing SOO°46'25 W,33.00 feet;thence N89°50'00 W,
164.79 feet;thence NOO°00'15 W,33.00 feet;thence
S89 °50'00"E,165.24 feet to the true point of beginning.

The north thirty-three (33')feet of the North I of the
Northwest A of the Southeast A of the Southeast A;EXCEPT
the west thirty-three (33')feet thereof.

Pinal County,Arizona;thence N89°49'58 W,660.36 feet along
the East-West quarter line of said Section 17;th rice

the East-West quarter line of said Section 17;thence
SOO°00'15"E,660.04 feet;thence N89°50'16"W,33.00 feet
to the true point of beginning of this description;thence
SOO°00'15"E,33.00 feet;thence N89°50'16 W,272.22 feet;
thence along a curve to the left 61.19 feet,said curve having
a radius of 50.00 feet,central angle of 70 0 07'18"and long
chord bearing N55°06'05"E,57.45 feet;thence S89°50'16"E,
225.11 feet to the true point of beginning.
WHEREAS,the abandonments requested,i f approved,would not
leave a parcel in separate ownership without access to an established
public roadway connecting such lands with another public roadway,or
have access by a federally patented easement which may i n the future
be developed;and
WHEREAS,the City Council of the City of Apache Junction,
Arizona,finds that these said federally patented easements for public
rights -of -way -purposes as described herein are classified as local
streets on the •Apache Junction Street Classification Plan and are no
longer necessary for public use as roadways;and
WHEREAS,these said easements requested for abandonment have
never been improved as public roadways and maintained by a local
•governing agency.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council
of the City of Apache Junction,Arizona,that the above -described
federally patented easements reserved for public rights -of -way purposes
are hereby abandoned and extinguished as present or future public
rights -of -way.
BE IT FURTHER RESOLVED,that the abandonment of the public
rights -of -way has no effect on reservations for public utility
easements.
BE IT FURTHER RESOLVED,that this Resolution shall be
adopted with the stipulation that i f the land i s not utilized for the
proposed project within a two (2)year period,the roadway abandonments
as specified herein shall revert to their original use.
PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,THIS 21ST DAY OF FEBRUARY ,19 84 .
