HomeMy WebLinkAboutRES 83-66RESOLUTION 83-66 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,-ARIZONA,DECLARING THAT CERTAIN FEDERALLY PATENTED EASEMENTS FOR PUBLIC RIGHTS -OF -WAY PURPOSES ON NORTH APACHE DRIVE FROM WEST ROUNDUP STREET' TO WEST TEPEE STREET;WEST SHIPROCK STREET FROM 225 FEET -WEST OF -NORTH APACHE DRIVE TO NORTH IDAHO -ROAD;AND WEST ROUNDUP STREET FROM NORTH PLAZA DRIVE TO 165 FEET EAST OF NORTH APACHE - DRIVE,AS DESCRIBED IN STREET ABANDONMENT CASE -AB -83-21, ARE NO LONGER-NECESSARY FOR PUBLIC USE AS ROADWAYS AND ARE HEREBY ABANDONED AND EXTINGUISHED AS PRESENT OR FUTURE PUBLIC RIGHTS -OF -WAY: WHEREAS,Mary Ann Lupo,Merl C.and Lucille H.Lehrkamp, Robert D.and Gloria L.Copper,John F.Gore,Violet Mesich Stajmiger, Nada M.Marcetich,Donna Mae Mesich,Shirley R.Knight,Alfred and Norma Jean Bellucci,E.Kenneth and Elsie V.Ragan,Terry N.Willenburg, Richard N.Mang,and Edward and Elizabeth Ginsburg have made application for the abandonment of federally patented easements on the property described in this Resolution;and WHEREAS,the requested abandonments are easements for public rights -of -way purposes described as these parcels of land located in Section 17,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,located in Apache Junction,Pinal County,Arizona,and more particularly described as follows: Parcel No.1: The west thirty-three (33')feet of the north thirty-three (33')feet of the North of the Northeast A of the Southeast A of the Southeast k;and Commencing at the east quarter corner of Section 17,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian, Pinal County,Arizona;thence south 1319.88 feet along the east line of said Section 17;thence N89°50'00"W,462.02 feet to the true point of beginning;thence along a curve to the left 33.63 feet,said curve having a radius of 50.00 feet,central angle of 38°32'23"and long chord bearing SOO°46'25 W,33.00 feet;thence N89°50'00 W, 164.79 feet;thence NOO°00'15 W,33.00 feet;thence S89 °50'00"E,165.24 feet to the true point of beginning. Parcel No.2: The north thirty-three (33')feet of the North I of the Northwest A of the Southeast A of the Southeast A;EXCEPT the west thirty-three (33')feet thereof. RESOLUTION NO.83-66 PAGE THREE Parcel No.11: The east thirty-three (33')feet of the North 1 of the Southwest 4 of the Northeast A of the Southeast 4;and Commencing at the east quarter corner of Section 17,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian, Pinal County,Arizona;thence N89°49'58"W,660.36 feet along the East-West quarter line of said Section 17;thence SOO°00'15"E,660.04 feet;thence N89°50'16"W,33.00 feet to the true point of beginning of this description;thence SOO°00'15"E,33.00 feet;thence N89°50'16 W,272.22 feet; thence along a curve to the left 61.19 feet,said curve having a radius of 50.00 feet,central angle of 70 0 07'18"and long chord bearing N55°06'05"E,57.45 feet;thence S89°50'16"E, 225.11 feet to the true point of beginning. WHEREAS,the abandonments requested,i f approved,would not leave a parcel in separate ownership without access to an established public roadway connecting such lands with another public roadway,or have access by a federally patented easement which may i n the future be developed;and WHEREAS,the City Council of the City of Apache Junction, Arizona,finds that these said federally patented easements for public rights -of -way -purposes as described herein are classified as local streets on the •Apache Junction Street Classification Plan and are no longer necessary for public use as roadways;and WHEREAS,these said easements requested for abandonment have never been improved as public roadways and maintained by a local •governing agency. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that the above -described federally patented easements reserved for public rights -of -way purposes are hereby abandoned and extinguished as present or future public rights -of -way. BE IT FURTHER RESOLVED,that the abandonment of the public rights -of -way has no effect on reservations for public utility easements. BE IT FURTHER RESOLVED,that this Resolution shall be adopted with the stipulation that i f the land i s not utilized for the proposed project within a two (2)year period,the roadway abandonments as specified herein shall revert to their original use.
