A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,DECLARING THAT RECREATIONAL
VEHICLE AND AUTO STORAGE AND PARKING ARE NOT MORE OBNOXIOUS
OR DETRIMENTAL THAN THOSE PERMITTED USES AS SET FORTH IN
THE CITY OF APACHE JUNCTION,ARIZONA,ZONING ORDINANCE SECTION
1501 (b),AND THAT RECREATIONAL VEHICLE AND AUTO STORAGE
AND PARKING ARE DECLARED TO BE PERMITTED USES IN SECTION
1501 (b)OF THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE.
WHEREAS,the Arizona Department of Transportation,Motor
Vehicle Division,i n the "Dealers and Wreckers Intruction Manual"dated March
1980,defines "Motor Vehicle,means an automobile,motor bus,motorcycle,
truck,truck tractor,or any other self-propelled vehicle,tractor or semi-
tractor.";and
WHEREAS,the Apache Junction,Arizona,Zoning Ordinance does not
define "motor vehicle;"and
WHEREAS,Keith Stachar by letter dated February 4,1983,has re-
quested the Apache Junction City Council to make an interpretation that a
Recreational Vehicle and Auto Storage and Parking i s a permitted use by
interpretation i n Section 1501 (b)of the Apache Junction,Arizona,Zoning
Ordinance;and
states:
WHEREAS,subsection (b)of Section 1501 of the said Zoning Ordinance
"Other similar enterprise or business of the same class,which i n
the opinion of the City Council,as evidenced by resolution or
record,i s not more obnoxious or detrimental to the welfare of the
particular community than the enterprises or businesses above
enumerated.";and
WHEREAS,Section 1501 (b)does list as a permitted use "Auto Parking
Lot (within and without building)";and
WHEREAS,Section 1501 (b)does list as a permitted use "Garage for
public storage only";and
WHEREAS,Sections 1501 (b)and 1601 (b)do not refer to Recreational
Vehicle Parking and Storage;
NOW,THEREFORE,BE IT RESOLVED,by the Mayor and City Council of the
City of Apache Junction,Arizona,that as permitted by Section 1501 (b)the
City Council notes that Auto Storage and Parking i s permitted i n Section 1501
(b),and declares that Recreational Vehicles are similar and would not be
obnoxious or detrimental within the CB -1 Local Business Zone and are therefore
declared to be a permitted use under Section 1501 (b)of the Apache Junction,
Arizona,Zoning Ordinance.
