A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,REPEALING RESOLUTION NO.82-69.
WHEREAS,the Apache Junction,Arizona,City Council did,on December 7,
1982,adopt Resolution No.82-69,said Resolution requesting approval from
the State of Arizona and the U.S.Environmental Protection Agency for funding
of a cooperative project to be undertaken by the Central Arizona Association
of Governments and City of Apache Junction,Arizona,as provided for in
Section 205(j)of the Clean Water Act in an amount estimated to be $10,000.00
total,said City providing a match of twenty-five (25%)percent estimated to
be $2,500.00 from Account #001-106-522-07-68.declaring that the City believes
that there is an important water quality problem and will try to implement
measures to alleviate or avoid water quality problems,and authorizing the
City Manager to enter into a cooperative agreement with the Central Arizona
Association of Governments to carry out this project;and
WHEREAS,the City of Apache Junction continues to believe that there may
be a present or future water quality problem;and
WHEREAS,i t appears that the levels of government failed to recognize the
fact that in the State of Arizona,funds allocated by local government cannot
be carried over to another fiscal year;and
WHEREAS,there was a sense of urgency to package and approve projects
i n December,creating the image that funding was eminent,therefore,this
project was prepared on that basis;and
WHEREAS,i t i s now months later and funding has not been approved by the
U.S.Environmental Protection Agency and there i s less that three (3)months
left in the budget year to complete the project;and
WHEREAS,the timetable simply no longer allows the project to be
completed due to the delay in funding approval and matching funds cannot be
guaranteed past June 30,1983;and
WHEREAS,no contracts have been offered or executed on this project and
no work has taken place;
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that:
1.Resolution No.82-69 i s hereby repealed;and
2.The City of Apache Junction withdraws its matching funds estimated
to be $2,500.00 from Account #001-106-522-07-68;and
3.The City Manager is directed to not execute any documents or
cooperative agreements to enter into this 205(j)program.
