HomeMy WebLinkAboutRES 83-20RESOLUTION NO.83-20 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,SUSPENDING THE ISSUANCE OF NEW BUILDING PERMITS,RESCINDING BUILDING PERMITS FOR NEW BUILDING CONSTRUCTION NOT STARTED AND LIMITING EXPANSION, ADDITIONS AND REMODELING OF EXISTING CONSTRUCTION IN SIERRA ENTRADA UNIT ONE,SIERRA ENTRADA UNIT TWO AND ALL OTHER AREAS PRESENTLY SERVED OR PLANNED TO BE SERVED BY SIERRA ENTRADA SEWAGE FACILITY. WHEREAS,Sierra Entrada Units One and Two subdivision plats and other commercial areas were approved by Pinal County prior to the City's incorporation;and WHEREAS,certain construction was discontinued by the developer for a period of time,by no fault of Pinal County or the City of Apache Junction; and WHEREAS,developers and contractors have applied to the City of Apache Junction for plan re -approvals and the issuance of permits;and WHEREAS,the City requires the developer to meet essentially the same development standards as previously required and approved by Pinal County;and WHEREAS,the developer has failed to complete the required improvements i n a reasonable period of time,after certain City requirements were relaxed;and WHEREAS,the design,operation and maintenance of the sewage facilities has frequently failed to meet the minimum standards of the Arizona Department of Health Services;and WHEREAS,the sewage facilities have repeatedly caused partially treated effluent to flow into the City's rights -of -way;and WHEREAS,the Arizona Bureau of Water Ouality Control on March 30,1983 voided all construction approvals for the Sierra Entrada Subdivision and also requested that the Arizona Department of Real Estate suspend the sale of all lots;and WHEREAS,on April 1,1983 the Commissioner of the Arizona Department of Real Estate suspended subdivision approval i n accordance with ARS 32-2184;and WHEREAS,the addition of new dwelling units or commercial businesses will compound the problems related to the operation and maintenance of the sanitary facilities; THEREFORE NOW BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that direction be given to the Building Official,through the City Manager and the Director of Public Works that except for building construction that does not increase fixture units or flows to the sewerage facilities,the issuance of new building permits be suspended and any new building construction not started be rescinded,until the developer meets all current minimum standards as required by the City, County and State agencies for subdivision approval and commercial development. BE IT FURTHER RESOLVED that this action become immediately effective,i n order to protect the health,safety and welfare of the community.
