JUNCTION, ARIZONA SETTING FORTH ITS INTENT TO APPROVE THE INTERGOVERNMENTAI,AGREEMENTI,BETWEENrTHESTATE,OF ARIZONA AND THE CITY OF APACHE JUNCTION FOR THE INSTALLATION OF TRAFFIC SIGNALS AT U.S. 60 AND IDAHO ROAD. •WHEREAS, the traffic count conducted by the Arizona Department of Transportation in March of 1980 revealed over 15,000 vehicles a day passed by this intersection; and WHEREAS, recent commercial developments have increased the vehicular and pedestrian activity in this area; and WHEREAS, the City believes it is in the best interest for the public safety and welfare -to -construct traffie signals in thedooation of U.S. 60 and Idaho Road; THEREFORE NOW BE IT RESOLVED that the City of Apache Junction, Arizona accept the construction intergovernmental agreement between the State of Arizona and the City of Apache Junction. PASSED this 5TH day of JULY , 1983 by the Mayor and the City Council of the City of Apache Junction, Arizona. ATTEST: Kathleen Connelly, City Clerk APPROVED AS TO FORM: endell J. tloeke, Mayor CONSTRUCTION INTERGOVERNMENTAL AGREEMENT BETWEEN THE STATE OF ARIZONA AND THE CITY OF APACHE JUNCTION THIS AGREEMENT,entered into pursuant to Arizona Revised Statutes, Section 11-951 through 11-954,by and between the STATE OF ARIZONA,acting by and through the ARIZONA DEPARTMENT OF TRANSPORTATION,hereinafter called "STATE"and the CITY OF APACHE JUNCTION,hereinafter called "CITY", WHEREAS,the STATE i s empowered by Arizona Revised Statutes Section 28-108 to enter into this AGREEMENT,and WHEREAS,the CITY i s empowered by Arizona Revised Statutes Section 9-672 to enter into this AGREEMENT,and acting by and through its duly elected governing body,has by that certain resolution attached hereto and incorporated herein as Exhibit "A"resolved to enter into this AGREEMENT and has authorized the undersigned as its representative to execute the same on behalf of said CITY,and WHEREAS,for the safety and protection of the traveling public,i t i s necessary and desirable that certain improvements and/or modifications be made on the State Highway System in the CITY.This work shall include but not be limited to the installation of new traffic signals on: US 60 and Idaho NOW,THEREFORE,i n consideration of the mutual covenants hereinafter to be kept by all parties,i t is mutually agreed as follows: Sheet 1 1.The STATE shall advertise for bids and award a contract for the installation of the traffic signals on US 60 at Idaho. 2.The CITY,upon completion of the work,shall reimburse the STATE for fifty percent (50%)of the final construction and engineering cost,not to exceed $50,570 for its share of the cost of this work. 3.The CITY will be responsible for all other improvements to intersection approaches north and south of US 60 beginning at the edge of existing pavement. 4.This AGREEMENT shall be considered as terminated when all conditions as set forth herein have been complied with and the traffic signals are complete,i n place,and functional. 5.All parties are hereby put on notice that this AGREEMENT i s subject to cancellation by the Governor pursuant to Arizona Revised Statutes Section 38-511. 6.This AGREEMENT shall be filed with the Secretary of State and shall become effective upon its being filed. 7.Attached to this AGREEMENT and incorporated herein by reference i s Exhibit "B"which i s a copy of the written determination of the appropriate attorney that the CITY i s authorized under the laws of this State to enter into this AGREEMENT and that i t i s i n proper form.
