A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,DECLARING THAT A CERTAIN FEDERALLY
PATENTED EASEMENT FOR PUBLIC RIGHT-OF-WAY PURPOSES ON
SOUTH CHAPARRAL ROAD AS DESCRIBED IN STREET ABANDONMENT CASE
AB -83-19 IS NO LONGER NECESSARY FOR PUBLIC USE AS A ROADWAY
AND IS HEREBY ABANDONED AND EXTINGUISHED AS A PRESENT OR
FUTURE PUBLIC RIGHT-OF-WAY.
WHEREAS,Carol E.Peterson,Frank R.and Judy L.Edwards,and
Frances M.Gustafson have made application for the abandonment of a federally
patented easement on the property described in this Resolution;and
WHEREAS,the requested abandonment i s an easement for public right-
of-way purposes described as these parcels of land located i n Section 22,
Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,
located i n Apache Junction,Pinal County,Arizona,and more particularly
described as follows:
Parcel No.1:
The east thirty-three (33')feet of the East 1 of the
Northwest k of the Northwest of the Southeast k of the
Southwest k of Section 22,Township 1 North,Range 8 East,
Gila and Salt River Base and Meridian,Apache Junction,
Pinal County,Arizona;EXCEPT the north thirty-three (33')
feet,and EXCEPT the south thirty-three (33')feet thereof
Parcel No.2:
The west thirty-three (33')feet of the Northeast k of the
Northwest k of the Southeast k of the Southwest of
Section 22,Township 1 North,Range 8 East,Gila and Salt
River Base and Meridian,Apache Junction,Pinal County,
Arizona;EXCEPT the north thirty-three (33')feet,and
EXCEPT the south thirty-three (33')feet thereof.
WHEREAS,the abandonment requested,i f approved,would not
leave a parcel i n separate ownership without access to an established
roadway connecting such lands with another public roadway,or have access
by a federally patented easement which may i n the future be developed;and
WHEREAS,the City Council of the City of Apache Junction,Arizona,
finds that the said federally patented easement for public right-of-way
purposes,as described herein,i s classified as a local street on the Apache
Junction Street Classification Plan,and i s no longer necessary for public
use as a roadway;and
WHEREAS,the said easement requested for abandonment has never
been improved as a public roadway and maintained by a local governing agency.
NOW THEREFORE,BE IT RESOLVED by the Mayor and City Council of the
City of Apache Junction,Arizona,that the above -described federally patented
easement reserved for public right-of-way purposes i s hereby abandoned and
extinguished as a present or future public right-of-way.
BE IT FURTHER RESOLVED,that the abandonment of the public right-
of-way has no effect on reservations for public utility easements.

APACHE JUNCTION,ARIZONA,THIS 15TH DAY OF NOVEMBER ,1983
