HomeMy WebLinkAboutRES 84-48RESOLUTION NO.84-48 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,DECLARING THAT CERTAIN DEDICATIONS FOR PUBLIC RIGHTS—OF—WAY ON NORTH GRAND DRIVE FROM WEST PIONEER STREET TO WEST SMOKETREE STREET,AS DESCRIBED IN STREET ABANDONMENT CASE AB -84-11,ARE NO LONGER NECESSARY FOR PUBLIC USE AS ROADWAYS AND ARE HEREBY VACATED AS PRESENT OR FUTURE PUBLIC RIGHTS—OF—WAY. WHEREAS,the requested abandonment i s a dedication for public rights—of—way purposes described as the parcel of land located in Section 18,Township 1 North,Range 8 East, Gila and Salt River Base and Meridian, Apache Junction,Pinal County,Arizona,and more particularly described as follows: Parcel No.1: The West thirty—three (33')feet of the Northwest *of the Southeast *of the Southwest *of the Northeast *,EXCEPT the North thirty—three (33')feet thereof. WHEREAS,the vacation requested,i f approved,would not leave a parcel i n separate ownership without access to an established public roadway connecting such lands with another public roadway,or have access by a federally patented easement which may in the future be developed;and WHEREAS,the City Council of the City of Apache Junction,Arizona finds that this said dedication for public rights—of—way purposes as de— scribed herein i s classified as a local street on the Apache Junction Street Classification Plan and i s no longer necessary for public use as a roadway; and WHEREAS,this said dedication requested for vacation has never been improved as a public roadway and maintained by a local governing agency. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that the above—described dedication reserved for public rights—of—way purposes i s hereby vacated as present or future public rights—of—way. BE IT FURTHER RESOLVED,that the vacation of the public rights— of—way has no effect on reservations for public utility easements.
