A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,DECLARING THAT CERTAIN PUBLIC
RIGHTS—OF—WAY FOR NESS BOULEVARD BETWEEN SUPERSTITION BOULE—
VARD AND SCENIC STREET,AS DESCRIBED IN STREET ABANDONMENT
CASE AB -84-16,ARE NO LONGER NECESSARY FOR PUBLIC USE AS
ROADWAYS AND ARE HEREBY VACATED AS PRESENT OR FUTURE PUBLIC
RIGHTS—OF—WAY.
WHEREAS,the requested abandonment i s a dedicated right—of—way
for public purposes described as a parcel of land located in a portion of
the Northeast 1 of Section 20,Township 1 North,Range 8 East,Gila and Salt
River Base and Meridian,Apache Junction,Pinal County,Arizona,and more
particularly described as follows:
Ness Boulevard,recorded in Book 11 of Maps,Page 24,
p.c.R.,described as follows:
Beginning at the Northeast corner of Section 20,being
a G.L.O.brass cap,thence:
N.89 °47'00"W.along the North line of the Northeast
quarter of Section 20,a distance of 326.50',thence:
S.0 0 05'15"W.,a distance of 50.00'to the TRUE POINT OF
BEGINNING,thence,continuing:
S.00 05'15"W.,a distance of 1238.76',thence:
N.89 °48'29"W.,a distance of 60.00',thence:
N.00 15'15"E.,a distance of 1218.74'to the beginning of
a tangent curve,thence:
Along said curve,a distance of 39.26'.Said curve has a A
of 90 0 03'15",a radius of 24.97',and a tangent of 25.00',con—
cave to the Southwest,thence:
S.89°47'00"E.,a distance of 85.00'to the TRUE POINT OF
BEGINNING.
WHEREAS,the abandonment requested,i f approved,would not leave
a parcel in separate ownership without access to an established public roadway;
and
WHEREAS,the City Council of the City of Apache Junction,Arizona,
finds that this right—of—way as described herein i s classified as a collector
street on the Apache Junction Street Classification Plan in a local street
alignment and i s no longer necessary for public use as roadways;and
WHEREAS,this right—of—way has never been improved as a public road—
way and i s not maintained by the City.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the
City of Apache Junction,Arizona,that the above—described right—of—way i s
hereby vacated as a present or future public right—of—way.
