A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,SETTING FORTH ITS UNCONDITIONAL
INTENT TO CONTRACT FOR CENTRAL ARIZONA PROJECT WATER
SUFFICIENT TO SUPPLY THE INTENDED USES WITHIN THE AREA
COVERED BY A PRIVATE WATER COMPANY'S CERTIFICATE OF
CONVENIENCE AND NECESSITY,IN THE EVENT THAT THE PRIVATE
WATER COMPANY REFUSES TO ENTER INTO A CONTRACT FOR CENTRAL
ARIZONA PROJECT WATER DURING THE CONTRACT PERIOD AND TO
MAKE THE_CENTRALARIZONA PROJECT WATER AVAILABLE TO SUPPLY
THE INTENDED USES WITHIN THE AREA COVERED BY THE PRIVATE
WATER COMPANY'S CERTIFICATE OF CONVENIENCE AND NECESSITY.
WHEREAS,the City of Apache Junction receives 100%of its municipal
and industrial water from the Arizona Water Company and Consolidated Water
Company,both privately owned water companies;and
WHEREAS,the Arizona Water Company has not entered into an
unconditional contract for the purchase of Central Arizona Project water
sufficient to supply the intended uses within the area covered by that
private water company's certificate of convenience and necessity;and
WHEREAS,the City of Apache Junction wishes to protect and maintain
whatever rights i t may now have or in the future may have to municipal or
industrial Central Arizona Project water;and
WHEREAS,A.R.S.Section 45-576 (G)provides for the passage of a
resolution wherein a city may express its unconditional intent to contract
for Central Arizona Project water sufficient to supply the intended uses
within the area covered by a private water company's certificate of conven-
ience and necessity,i n the event the private water company refuses to enter
into a contract for Central Arizona Project water during the contract period
as determined by the Director and to make the Central Arizona Project water
available to supply the intended uses within the area covered by the private
water company's certificate of convenience and necessity;and
WHEREAS,the City of Apache Junction is desirous of contracting for
the delivery of Central Arizona Project water under approved contract terms
and conditions with the Department of Interior and the Secretary of Interior,
THEREFORE,NOW BE IT RESOLVED the the City of Apache Junction,
Arizona,hereby expressly states its unconditional intent to contract for
Central Arizona Project water sufficient to supply the intended uses within
the area covered by the Arizona Water Company's certificate of convenience
and necessity,i n the event that Arizona Water Company refuses to enter into
a contract for Central Arizona Project Water during the contract period as
determined by the Director;and to make the Central Arizona Project water
available to supply the intended uses within the area covered by the Arizona
Water Company's certificate of convenience and necessity,and
BE IT FURTHER RESOLVED,authorizing the City Manager to take such
steps necessary as to insure compliance with A.R.S.Section 45-576 (G),and
those requirements imposed by the Central Arizona Water Conservation District,
2336 North Seventh Street,Phoenix,Arizona 85024,ATTN:Thomas C.Clark,
General Manager;and also to forward certified copies of this Resolution
to such other parties and agencies as determined by the Central Arizona
Water Conservation District.

THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA.
