A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,DECLARING THAT A CERTAIN FEDERALLY
PATENTED EASEMENT FOR PUBLIC RIGHT-OF-WAY PURPOSES ON
WINDSONG STREET FROM NORTH HILTON ROAD EAST TO GOLDFIELD ROAD
AS DESCRIBED IN STREET ABANDONMENT CASE AB -84-22 IS NO LONGER
NECESSARY FOR PUBLIC USE AS A ROADWAY AND IS HEREBY ABANDONED
AND EXTINGUISHED AS A PRESENT OR FUTURE PUBLIC RIGHT-OF-WAY.
WHEREAS,the requested abandonment i s a federally patented
easement described as parcels of land located i n a portion of Section 15,
Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,
Apache Junction,Pinal County,Arizona,and more particularly described as
follows:
Parcel No.1
The South thirty-three (33')feet of the NEI of the NEI of
the NEI of Section 15 Township 1 North,Range 8 East,Gila
and Salt River Base and Meridian,Apache Junction,Pinal
County,Arizona;
EXCEPT the East fifty (50')feet,and
EXCEPT the West thirty-three (33')feet thereof.
Parcle No.2
The North thirty-three (33')feet of the SE/of the NE/of
the NEI of Section 15 Township 1 North,Range 8 East,Gila
and Salt River Base and Meridian,Apache Junction,Pinal
County,Arizona;
EXCEPT the East fifty (50')feet,and
EXCEPT the West thirty-three (33')feet thereof.
WHEREAS,the abandonment requested,i f approved,would not
leave a parcel in separate ownership without access to an established road-
way connecting such lands with another public roadway,or have access by a
federally patented easement which may in the future be developed;and
WHEREAS,the City Council of the City of Apache Junction,Arizona,
finds that the said federally patented easement for public right-of-way
purposes,as described herein,i s classified as a local street on the Apache
Junction Street Classification Plan,and i s no longer necessary for public
use as a roadway;and
WHEREAS,the said easement requested for abandonment has never
been improved as a public roadway and maintained by a local governing agency.
NOW THEREFORE,BE IT RESOLVED by the Mayor and City Council of the
City of Apache Junction,Arizona,that the above -described federally patented
easement reserved for public right-of-way purposes i s hereby abandoned and
extinguished as a present or future public right-of-way.
BE IT FURTHER RESOLVED,that the abandonment of the public right-
of-way has no effect on reservations for public utility easements.
PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,THIS 5TH DAY OF FEBRUARY ,1985.
