A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,DECLARING THAT A CERTAIN DEDICATED
EASEMENT FOR PUBLIC RIGHT-OF-WAY PURPOSES ON "A"STREET,
AS DESCRIBED IN STREET ABANDONMENT CASE AB -84-2,IS NO
LONGER. NECESSARY FOR PUBLIC USE AS A ROADWAY AND IS HEREBY
ABANDONED AND EXTINGUISHED AS A PRESENT OR FUTURE PUBLIC
RIGHT-OF-WAY.
WHEREAS,the property owners made an application for abandon-
ment to Pinal County;and
WHEREAS,Pinal County abandoned the roadway i n 1970;and
WHEREAS,Pinal County rescinded the abandonment i n 1971 and did
not recOrd the rescindation-until 1981;and
WHEREAS,the property owners were not advised of the rescindation;and
•WHEREAS,the property owners have requested the City of Apache
Junction to reabandon the dedicated easement on the property described in
this Resolution;and
WHEREAS,the requested abandonment i s an easement for public right-
of-way purposes described as these parcels of land located in Section 19,
Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,
located i n Apache Junction,Pinal County,Arizona,and more particularly
described as follows:
Parcel No.1:
Beginning at the southwest corner of Lot 11,Superstition Homes,
according to Book 6 of Maps,Page 45,Pinal County,Arizona;
thence east along the south property line of Lot 11,a distance
of 130 feet to the southeast corner of Lot 11;thence SO°01'W,
a distance of twenty-five (25')feet to a point on the centerline
of the street known as "A"Street,said centerline being parallel
with the south property line of Lot 11;thence west a distance
of 130 feet along said centerline to a point;thence NO°Ol'E,
a distance of twenty-five (25')feet to the point of beginning.
Parcel No.2:
Beginning at the northwest corner of Lot 12,Superstition Homes,
according to Book 6 of Maps,Page 45,Pinal County,Arizona;
thence east along the north property line of Lot 12,a distance
of 130 feet to the northeast corner of Lot 12;thence NO°Ol'E,
a distance of twenty-five (25')feet to a point on the centerline
of the street known as "A"Street,said centerline being parallel
with the north property line of Lot 12;thence west a distance
of 130 feet along said centerline to a point;thence SO°01'W,
a distance of twenty-five (25')feet to the point of beginning.
Parcel No.3:
Beginning at the southeast corner of Lot 38,Superstition Homes,
according to Book 6 of Maps,Page 45,Pinal County,Arizona;
thence west along the south property line of Lot 38,a distance
of 129.46 feet to the southwest corner of Lot 38;thence SO° 011101,
a distance of twenty-five (25')feet to a point on the centerline
of the street known as "A"Street,said centerline being parallel
with the south property line of Lot 38;thence east a distance
of 129.46 feet along said centerline to a point;thence NO°01'W,
a distance of twenty-five (25')feet to the point of beginning.

Parcel No.4:
Beginning at the northeast corner of Lot 37,Superstition Homes,
according to Book 6 of Maps,Page 45,Pinal County,Arizona;
thence west along the north property line of Lot 37,a distance
of 129.46 feet to the northwest corner of Lot 37;thence NO°Ol'E,
a distance of twenty-five (25')feet to a point on the centerline
of the street known as "A"Street,said centerline being parallel
with the north property line of Lot 37;thence east a distance
of 129.46 feet along said centerline to a point;thence SO°01'W,
a distance of twenty-five feet to the point of beginning.
WHEREAS,the abandonments requested,i f approved,would not leave
a parcel in separate ownership without access to an established public
roadway connecting such lands with another public roadway,or have access
by a federally patented easement which may in the future be developed;and
WHEREAS,the City Council of the City of Apache Junction,Arizona
finds that the said dedicated easement for public right-of-way purposes as
described herein i s classified as a local street on the Apache Junction
Street Classification Plan,and i s no longer necessary for public use as a
roadway;and
WHEREAS,the said easement requested for abandonment has never been
improved as a public roadway and maintained by a local governing agency.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the
City of Apache Junction,Arizona,that the above -described dedicated easement
reserved for public right-of-way purposes i s hereby abandoned and extinguished
as a present or future public right-of-way.
BE IT FURTHER RESOLVED,that the abandonment of the public right-
of-way has no effect on reservations for public utility easements.

APACHE JUNCTION,ARIZONA,THIS 7TH DAY OF FEBRUARY•,19 84 .
