A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,CORRECTING RESOLUTION NO.84-60 AND DECLARING THAT
CERTAIN PUBLIC RIGHTS -OF -WAY ON SAN MARCOS DRIVE FROM VIRGINIA STREET,
SOUTH 775.79 FEET AS DESCRIBED IN STREET ABANDONMENT CASE AB -81-9 ARE
NO LONGER NECESSARY FOR PUBLIC USE AND ARE HEREBY VACATED:AND BY
AMENDING THIS STREET CLASSIFICATION PLAN.
WHEREAS,the requested vacation are public rights -of -way located i n a
portion of the Northeast Quarter of Section 20,Township 1 North,Range 8
East,of the Gila and Salt River Base and Meridian,Pinal County,Arizona,
more particularly described as follows:
Beginning at the Southeast corner of Beaty Subdivision,as recorded i n
Book 9,Map 40,P.C.R.,said point also being the centerline of Virginia
Street (Superstition Drive)and the True Point of Beginning;
Thence continuing South along the North -South midsection line
775.79 feet;
Thence East 40 feet;
Thence North 775.79 feet;
Thence West 40 feet,back to the True Point of Beginning.
WHEREAS,the vacation requested,i f approved,would not leave a parcel
i n separate ownership without access to an established public roadway
connecting such lands with another public roadway;and
WHEREAS,the City Council of the City of Apache Junction,Arizona,finds
that these public rights -of -way are not developed and are no longer necessary
for public use as roadways;and
WHEREAS,these rights -of -way requested for vacation have never been improved
as public roadways and maintained by a local governing agency.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that the above -described public rights -of -way
are hereby vacated.
BE IT FURTHER RESOLVED by the Mayor and City Council of the City of Apache
Junction,Arizona,as follows:
The requirement to provide a midsection line right-of-way along the San
Marcos Drive alignment between the North (Superstition Boulevard)and the South
(Broadway Road)lines in Section 20 be deleted;and reclassifying that portion
of San Marcos Drive adjacent to the East line of Beaty Subdivision,as recorded
i n Book 9,Page 40,P.C.R.,from a mid -section to a residential street.
PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,THIS 17TH DAY OF SEPTEMBER,1985.
