A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,DECLARING THAT A PORTION OF PLAZA DRIVE NORTH
OF US HIGHWAY 60,70,80 AND 89 AS DESCRIBED IN STREET ABANDONMENT
CASE AB -85-10 IS NO LONGER FUNCTIONAL FOR PUBLIC USE AND IS HEREBY
VACATED.
WHEREAS,the requested vacation are public rights -of -way located i n
a portion of the Southeast quarter of the Northeast quarter of Section 20,
Township 1 North,Range 8 East of the Gila and Salt River Base and
Meridian,Pinal County,Arizona,more particularly described as follows:
All that tract or parcel of land lying wholly within a portion of the
Northeast Quarter of Section 20,Township 1 North,Range 8 East of the
Gila and Salt River Base and Meridian,Pinal County,Arizona.Said
tract being a portion of the right-of-way of Plaza Drive (Lost Dutchman
Boulevard)as established on the Dedication of Right -of -Way for Streets,
Map as recorded i n the Pinal County Recorder's Office i n Book of Maps 11
on Page 24,and being further described as follows:
Commencing at the Northeast corner of Section 20;
Thence North 89 °47'00"West along the North line of said Section 20,
a distance of 1,319.40 feet to the intersection of said North line
and the centerline of Plaza Drive (Lost Dutchman Boulevard);
Thence South 0 004 115"West along said centerline a distance of
502.05 feet;
Thence South 11 °51'38"West,a distance of 100.00 feet;
Thence South 0 004 115"West,a distance of 1,161.56 feet;
Thence South 9 °38'30"East,a distance of 87.66 feet to the Point
of Beginning;
Thence North 85 012'52.5"East,a distance of 40.14 feet to a point i n
the East right-of-way line of Plaza Drive (Lost Dutchman Boulevard);
Thence South 0 004 115"West,a distance of 470.00 feet;
Thence South 35 °08'03"East,a distance of 208.35 feet to a point in
the North right-of-way line of Apache Trail (Highway U.S.60);
Thence along said North right-of-way line along a concave curve to
the Southwest having a delta 5°05'38",a radius of 905 feet,and a
length of arc of 80.46 feet;
Thence North 35 °08'03"West along the West right-of-way line of Plaza
Drive (Lost Dutchman Boulevard)a distance of 222.52 feet;
Thence North 0 004'15"East,a distance of 487.82 feet;
Thence North 85 °12'52.5"East,a distance of 40.14 feet to a point
i n the centerline of Plaza Drive (Lost Dutchman Boulevard),the
Point of Beginning.
WHEREAS,the vacation requested,i f approved,would not leave a parcel
i n separate ownership without access to an established public roadway connecting
such lands with another public roadway;and
WHEREAS,the City Council of the City of Apache Junction,Arizona,finds
that these public rights -of -way are no longer functional for public use as
roadways due to the reconstruction of US 60 and SR 88;and
WHEREAS,traffic safety would be enhanced.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that the above—described public rights—of—way
are hereby vacated as present or future public rights—of—way.Subject to
easements for emergency vehicles and utilities as may be appropriate and
contingent upon the reconstruction of the intersection of US, 60 and SR 88.
PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,THIS 1st DAY OF October ,1985.
