A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,DECLARING THAT CERTAIN FEDERALLY PATENTED
EASEMENTS FOR PUBLIC RIGHTS -OF -WAY PURPOSES ON 22ND AVENUE
FROM CORTEZ ROAD TO ACACIA ROAD AND STAGECOACH ROAD FROM
SOUTHERN AVENUE TO U.S.HIGHWAY 60-70-80-89 AS DESCRIBED IN STREET
ABANDONMENT CASE AB -85-09,ARE NO LONGER NECESSARY FOR PUBLIC USE
AS A ROADWAY AND ARE HEREBY ABANDONED AND EXTINGUISHED AS PRESENT
OR FUTURE PUBLIC RIGHTS -OF -WAY.
WHEREAS,the requested abandonments are Federally Patented Easements
described as parcels of land located i n a portion of Section 27,Township
1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,
Pinal County,Arizona,and more particularly described as follows:
The North sixty-six feet (66')of the South six hundred ninety-three
feet (693')of the South half of the West half of the Southwest
quarter of the Southeast quarter of Section 27.
EXCEPT the West forty feet (40');and
EXCEPT the East thirty-three feet (33')thereof.
The East sixty-six feet (66')of the West three hundred sixty-three
feet (363')of the West half of the Southwest quarter of the
Southeast quarter of Section 27.Lying South of the South
Right -of -Way line of U.S.Highway U.S.60-70-80-89.
EXCEPT the South fifty feet (50')thereof.
WHEREAS,the abandonment requested,i f approved,would not leave a parcel
i n separate ownership without access to an established public roadway connecting
such lands with another public roadway,or have access by a Federally Patented
Easement which may in the future be developed;and
WHEREAS,the City Council of the City of Apache Junction,Arizona,finds
that these said Federally Patented Easements for public rights -of -way purposes
as described herein,are classified as local streets on the Apache Junction
Street Classification Plan,and are no longer necessary for public use as
roadways;and
WHEREAS,these said easements requested for abandonment have never been
improved as public roadways and maintained by a local governing agency.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that the above -described Federally Patented
Easement reserved for public rights -of -way purposes are hereby
abandoned and extinguished as present or future public rights -of -way.
BE IT FURTHER RESOLVED that the abandonment of the public rights -of -way
has no effect on reservations for public utility easements.

JUNCTION,ARIZONA,THIS 1ST DAY OF OCTOBER ,1985.
