RESOLUTION NO.85-46
A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AUTHORIZING THE REDEMPTION OF PRIOR SERVICE
CREDITS WITH THE ARIZONA PUBLIC SAFETY PERSONNEL RETIREMENT
SYSTEM FOR THOSE EMPLOYEES WHO MEET THE CRITERIA ESTABLISHED BY
§38-853.01 OF THE ARIZONA REVISED STATUTES.
WHEREAS,many of the City of Apache Junction's sworn police officers
were employed by other law enforcement agencies within the State of Arizona
prior to their employment with the City of Apache Junction;and
WHEREAS,some of these agencies participated in retirment plans other
than the Arizona Publice Safety Personnel Retirement System;and
WHEREAS,these employees were compelled to terminate their
participation with other retirement systems in order to participate in the
Public Safety Personnel Retirement System,there by losing years of service for
retirement purposes;and
WHEREAS,some of these agencies have since begun participation i n the
Public Safety Personnel Retirement System;and
WHEREAS,Arizona Revised Statutes,§38-853.01 provides guidelines
and criteria for buying back prior service credits in certain,specified
circumstances;and
WHEREAS,Arizona Revised Statutes,§38-853.01 (C)provides that
active members of the system who are employed by the City may only redeem prior
service credit for eligible employees i f the City Council authorizes the
redemption of prior service credit for eligible employees;
NOW,THEREFORE,be i t resolved by the Mayor and City Council of the
City of Apache Junction that any active member of the Public Safety Personnel
Retirement System meeting the criteria outlined by A.R.S.38-853.01 be
authorized to redeem prior service.
