A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA ESTABLISHING A POLICY TO BE USED AS A GUIDELINE
FOR THE ABANDONMENT OR VACATION OF ROADS.
WHEREAS,several sections of the City have established Federally
Patented Easements that may not be required for future street development;
and
WHEREAS,property owners occasionally desire to abandon or vacate
existing easements or rights -of -way;and
WHEREAS,future residential roadway alignments can not be comprehensively
mapped due to drainage,topography,zoning,existing utilities and land
development patterns;and
WHEREAS,certain roads should be preserved for present and future
transportation needs.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of
the City of Apache Junction as follows:
I .The following roadways will not be abandoned unless special conditions
would warrant:
A.Section line roads (1 -mile).
B.Mid -section line roads (1 -mile).
C.Collector streets (i-mile).
II.Residential streets may be abandoned on a case -by -case basis for
the following reasons:
A.I t discourages through -traffic in residential areas thus reducing
speed,traffic volumes,and minimizing dust.
B.I t permits consolidation of small parcels into larger tracts
for the development of land.
C.I t increases traffic safety by minimizing intersections on higher
roadway classifications.
D.City maintenance and road development costs are minimized.
E.Creation of double -fronted lots i s minimized.
F.Overall,the dust problem would be minimized.
G.I t allows for enhanced property uses (property owners can utilize
easement areas for personal purposes).
H.In many instances,the General Plan calls for low density which
would be considered to be l i acre lots or larger,which would
not require the street system of areas of higher density.
I .I t limits access onto State roadways,which in some cases bisect
other streets at oblique angles making access and visibility
unsafe.
J.All property owners have access to a public right-of-way or
easement.
