A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,DECLARING THAT A CERTAIN DEDICATED RIGHT-OF-WAY
FOR PUBLIC RIGHT-OF-WAY PURPOSES DESCRIBED AS NAVAJO AVENUE,EAST
OF CACTUS ROAD TO THE EAST BOUNDARY OF PALM SPRINGS UNIT TWO SUB-
DIVISION,IN STREET ABANDONMENT CASE NO.AB -85-17 IS NO LONGER
NECESSARY FOR PUBLIC USE AS A ROADWAY AND IS HEREBY ABANDONED AND
EXTINGUISHED AS PRESENT OR FUTURE PUBLIC RIGHT-OF-WAY.
WHEREAS,the requested abandonment i s a dedicated right-of-way described
as a parcel of land located i n Palm Springs Unit Two Subdivision i n a part of
Section 28,Township 1 North,Range 8 East of Gila and Salt River Base and
Meridian,as recorded i n Book 8 Page 3 of Pinal County Records,Pinal County,
Arizona,and more particularly described as follows:
Navajo Avenue (Drive)East of the East Right -of -Way line of
Cactus Road (Third Street)and between Lots 398 and 399 to
the East property line of Palm Springs Unit Two Subdivision.
WHEREAS,the abandonment requested,i f approved,would not leave a parcel
i n separate ownership without access to an established public roadway connect-
ing such lands with another public roadway;and
WHEREAS,the City Council of the City of Apache Junction,Arizona,finds that
this dedicated right-of-way for public right-of-way purposes as described herein
i s classified as a local street on the Apache Junction Street Classification
Plan and i s no longer necessary for public use as a roadway;and
WHEREAS,this said right-of-way requested for abandonment has never been
improved as a public roadway and maintained by a local governing agency.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of
Apache Junction,Arizona,that the above -described dedicated right-of-way for
public right-of-way purposes i s hereby vacated as present or future public
right-of-way.
BE IT FURTHER RESOLVED that the abandonment of the public right-of-way has
no effect on reservations for public utility easements.
PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THIS 7TH DAY OF JANUARY ,19 86.
