A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,DECLARING THAT A CERTAIN RIGHT-OF-
WAY ON OHIO STREET FROM THE WESTERLY RIGHT-OF-WAY LINE ON
PINYON DRIVE TO THE WEST PROPERTY LINE OF LOT 2 BLOCK 3 AND
LOT 1 BLOCK 6,AND ON CODY STREET (CENTURY STREET)FROM THE
WESTERLY RIGHT-OF-WAY LINE ON PINYON STREET TO THE WEST
PROPERTY LINE OF LOT 2 BLOCK 6 AND LOT 1 BLOCK 7 AS RECORDED
IN PUEBLO DEL SOL -A SUBDIVISION OF RECORD IN PINAL COUNTY
RECORDERS BOOK 9 PAGE 4 AND AS DESCRIBED IN STREET ABANDONMENT
CASE AB -85-03 ARE NO LONGER NECESSARY FOR PUBLIC USE AS
ROADWAYS AND ARE HEREBY VACATED AS A PRESENT OR FUTURE RIGHT-
OF-WAYS CONDITIONED UPON PROVISIONS FOR UTILITY EASEMENTS.
WHEREAS,the requested abandonment i s a dedication for public rights-
of -way purposes described as these parcels of land located in Section 19,
Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,
Apache Junction,Pinal County,Arizona,and more particularly described
as follows:
Parcels No.1
That portion of Ohio Street i n Pueblo Del Sol,a subdivision in Book 9
Page 4,Pinal County Recorder,lying West of the Westerly right-of-way
line of Pinyon Drive,Northerly of Lot 1 Block 6 and Southerly of Lot 2,
Block 3.
Parcel No.2
That parcel of Cody Street i n Pueblo Del Sol,a subdivision as recorded
in Book 9 Page 4 Pinal County Recorder Tying Southerly of Lot 2 Block 6,
Northerly of Lot 1 Block 7 and West of the Westerly right-of-way line
of Pinyon Drive described as follows:
Beginning at the North Point of curvature at the Southeast corner of
Lot 2 Block 6;Thence continue Southerly along the extension of the
exact property line of said Lot 2 to the centerline of Cody Street
(Century Street);Thence continue Southeasterly to the South point of
curvature of the North corner of Lot 1 Block 7.
WHEREAS,the vacation requested,i f approved,would not leave a
parcel in separate ownership without access to an established public
roadway connecting such lands with another public roadway,or have access
by a federally patented easement which may in the future be developed;and
WHEREAS,the City Council of the City of Apache Junction,Arizona
finds that this said dedication for public rights -of -way purposes as
described herein i s classified as a local street on the Apache Junction
Street Classification Plan and i s no longer necessary for public use as
a roadway:and
WHEREAS,this said dedication requested for vacation has been
improved as a public roadway and maintained by a local governing agency.
NOW,THEREFORE,BE IT RESOLVED by the MaYor and City Council of
the City of Apache Junction,Arizona,that the above described dedication
reserved for public Tights -of -way purposes is hereby vacated as present
or future public rights -of -way and deleted from City maintenance.
BE IT FURTHER RESOLVED that the vacation of the public rights -of-
way is conditioned upon providing public utility easements as described
in attachments "A"and "B".
