HomeMy WebLinkAboutRES 85-14RESOLUTION NO.85-14 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,DECLARING THAT A CERTAIN FEDERALLY PATENTED EASEMENT FOR PUBLIC RIGHT-OF-WAY PURPOSES DESERT VIEW FROM GREASEWOOD STREET TO SUPERSTITION BOULEVARD.AS DESCRIBED IN STREET ABANDONMENT CASE AB -85-02 IS NO LONGER NECESSARY FOR PUBLIC USE AS A ROADWAY AND IS HEREBY ABANDONED AND EXTINGUISHED AS A PRESENT OR FUTURE PUBLIC RIGHT-OF-WAY. WHEREAS,the requested abandonment i s a federally patented easement described as parcels of land located i n a portion of Section 18,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction, Pinal County,Arizona,and more particularly described as follows: Parcel No.1 The East thirty-three (33')feet of the Southwest quarter of the Southeast quarter of the Southwest quarter of Section 18 Township 1 North,Range 8 East,Gila and Salt River Basin and Meridian,Apache Junction,Pinal County, Arizona: EXCEPT the North thrity-three (33')feet;:and EXCEPT the South fifty (50')feet thereof. Parcel No.2 The West thirty-three (33')feet of the Southeast quarter of the Southeast quarter of the Southwest quarter of Section 18,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal County, Arizona: EXCEPT the North thirty-three (33')feet;and EXCEPT the South fifty (50')feet thereof. WHEREAS,the abandonments requested,i f approved,would not leave a parcel i n separate ownership without access to an established public roadway connecting such lands with another public roadway,or have access by a Federally Patented Easement which may in the future be developed;and WHEREAS,the City Council of the City of Apache Junction,Arizona, finds that these said Federally Patented Easements for public rights -of- way purposes as described herein are classified as local streets on the Apache Junction Street Classification Plan are no longer necessary for public use as roadways;and WHEREAS,these said easements requested for abandonment have never been improved as public roadways and maintained by a local governing agency. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that the above described Federally Patented Easements reserved for public rights -of -way purposes are hereby abandonment and extinguished as present or future public rights -of -way. BE IT FRUTHER RESOLVED that the abandonment of the public rights- of -way has no effect on reservations for public utility easements. PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,THIS 16TH PAY OF APRIL ,1985.
