A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,DECLARING THAT CERTAIN DEDICATIONS
FOR PUBLIC RIGHTS -OF -WAY ON CONESTOGA ROAD FROM TAMARISK
STREET TO JUNCTION STREET,AS DESCRIBED IN STREET ABANDON-
MENT CASE AB -84-20,ARE NO LONGER NECESSARY FOR PUBLIC USE
AS ROADWAYS AND ARE HEREBY VACATED AS PRESENT OR FUTURE
PUBLIC RIGHTS -OF -WAY.
WHEREAS,the requested abandonment i s an easement for public rights -of-
way purposes described as these parcels of land located i n Section 22,Town-
ship 1 North,Range 8 East of the Gila and Salt River Base and Meridian,
Apache Junction,Pinal County,Arizona,and more particularly described as
follows:
Parcel No.1
The West Thirty -Three feet (33')of the Southeast Quarter of the
Southeast Quarter of the Southeast Quarter of the Northwest Quarter;
EXCEPT the South Forty feet (40')and EXCEPT the North Thirty -Three
feet (33')thereof.
WHEREAS,the abandonments requested,i f approved,would not leave a
parcel i n separate ownership without access to an established public roadway
connecting such lands with another public roadway,or have access by a Federally
Patented Easement which may i n the future be developed;and
WHEREAS,the City Council of the City of Apache Junction,Arizona,finds
that this said dedication for public rights -of -way purposes as described herein
i s classified as a local street on the Apache Junction Street Classification
Plan,and i s no longer necessary for public use as a roadway;and
WHEREAS,this said dedication requested for vacation has never been improved
as public roadways and maintained by a local governing agency.
NOW THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that the above -described dedication reserved for
public rights -of -way purposes i s hereby vacated as present or future public
rights -of -ways.
BE IT FURTHER RESOLVED that the vacation of the public right-of-way has
no effect on reservations for public utility easements.
