A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,DECLARING THAT A CERTAIN FEDERALLY PATENTED
EASEMENT FOR PUBLIC RIGHTS—OF—WAY PURPOSES DESCRIBED AS FIFTH
AVENUE BETWEEN CORTEZ ROAD AND CONESTOGA ROAD DESCRIBED IN STREET
ABANDONMENT CASE AB -86-06,IS NO LONGER NECESSARY FOR PUBLIC USE
AS A ROADWAY AND IS HEREBY ABANDONED AND EXTINGUISHED AS
PRESENT OR FUTURE PUBLIC RIGHTS—OF—WAY.
WHEREAS,the requested abandonment i s a Federally Patented Easement
for public rights—of—way purposes described as a parcel of land located in
Section 22,Township 1 North,Range 8 East,Gila and Salt River Base and
Meridian,Apache Junction,Pinal County,Arizona,and more particularly
described as follows:
The South sixty six (66')feet of the North three hundred sixty
three (363')feet of the East half of the Northeast quarter
of the Southeast Quarter of the Southwest quarter of Section 22.
Except the East forty (40')feet and
Except the West thirty three (33')feet thereof.
WHEREAS,the abandonment requested,i f approved,would not leave a parcel
i n separate ownership without access to an established public roadway connecting
such lands with another public roadway,or have access by a Federally Patented
Easement which may in the future be developed;and
WHEREAS,the City Council of the City of Apache Junction,Arizona,finds
that said Federally Patented Easement for public rights—of—way purposes
as described herein,i s classified as a local street on the Apache Junction
Street Classification Plan,and i s no longer necessary for public use as
a roadway;and
WHEREAS,said easement requested for abandonment has never been
improved as a public roadway and maintained by a local governing agency.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that the above—described Federally Patented
Easement reserved for public rights—of—way purposes i s hereby extinguished
as present or future public rights—of—way.
BE IT FURTHER RESOLVED that the abandonment of the public rights—of—way
has no effect on reservations for public utility easements.
PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,THIS 21ST DAY OF OCTOBER ,1986.
