A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,DECLARING THAT A CERTAIN FEDERALLY PATENTED
EASEMENT AND DEDICATED PUBLIC RIGHT-OF-WAY ON 9TH AVENUE
BETWEEN WICKIUP ROAD AND BOWMAN ROAD AS DESCRIBED IN STREET
ABANDONMENT CASE #AB -85-13,ARE NO LONGER NECESSARY FOR PUBLIC
USE AS ROADWAYS AND ARE HEREBY EXTINQUISHED AND VACATED AS PRESENT
OR FUTURE PUBLIC RIGHT-OF-WAY.
WHEREAS,the requested abandonment and vacation are parcels of land
located i n Section 27,Township 1 North,Range 8 East,Gila and Salt River
Base and Meridian,Apache Junction,Pinal County,Arizona,and more particularly
described as follows:
Ninth Avenue
The South sixty-six (66')feet of the North three hundred sixty-three
(363')feet of the West half of the Northeast quarter of the Northwest
quarter of Section 27.
WHEREAS,the abandonment requested,i f approved,would not leave a parcel
i n separate ownership without access to an established public roadway connecting
such lands with another public roadway,and
WHEREAS,the City Council of the City of Apache Junction,Arizona,finds
that said Federally Patented Easement and Dedication for public right-of-way
purposes as described herein,are classified as local streets on the Apache
Junction Street Classification Plan,and i s no longer necessary for public
use as roadways.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that the above -described Federally Patented
Easement and Dedication for public right-of-way purposes are hereby
abandoned and extinguished as present or future public rights -of -way.
BE IT FURTHER RESOLVED that the abandonment and vacation of the public
right-of-way has no effect on reservations for public utility easements.
